The National Intellectual Property Office’s Operational Guidelines on Submission of Intermediate Documents for PCT Applications Entering the National Phase

All patent agencies and patent applicants:
Recently, it was discovered that some patent agencies and patent applicants did not submit the intermediate documents through the correct entrance when using the client to submit PCT applications to enter the national phase with the international application number, causing the system files to be unable to be distributed normally after being received. In order to avoid the above situation, patent agencies and patent applicants are required to submit intermediate documents for entering the national phase of PCT applications in the following ways:
1. Before January 20, 2024 (excluding this date), when applicants use the client to submit intermediate documents, they should submit documents in accordance with the following requirements.
(1) If the applicant has not yet obtained a national application number and needs to use an international application number to submit intermediate documents, he should submit them through the "Statement of Opinions/Supplements" - "Proactive Submission Before PCT Entry" portal. Except for the above-mentioned entrances, when submitting intermediate documents, applicants are not allowed to use the international application number to submit intermediate documents.
(2) If the applicant has obtained a national application number, the intermediate document should be submitted using the national application number.
2. After January 20, 2024 (inclusive), when applicants use the client to submit intermediate documents, the following request-type documents will be able to submit intermediate documents using the international application number.
(1) Request for substantive examination
Applicants can submit a request for substantive examination using the international application number through the "Procedures" - "Request for Substantive Examination" portal.
(2) Correction of priority request
The applicant can submit a request for correction of priority using the international application number through the "Procedures" - "Correction of Priority" portal. (Note that this is not the "Add or Correct Priority" entry)
(3) Request for restoration of priority
Applicants can submit a priority restoration request using the international application number through the "Procedures" - "Priority Restoration Request (Active Restoration)" portal.
