State Intellectual Property Office: National standard "Patent Assessment Guidelines" officially released

In order to thoroughly implement the decisions and arrangements of the Party Central Committee and the State Council and improve the intellectual property evaluation system, the State Intellectual Property Office, together with the People's Bank of China and the State Financial Supervision and Administration Bureau, organized the preparation of recommended national standards 👉"Patent Evaluation Guidelines"👈(National Standard No. GB /T42748-2023, hereinafter referred to as the "Guidelines"), has recently been approved and released by the State Administration for Market Regulation (National Standardization Administration Committee) and will be implemented from September 1, 2023.
The "Guidelines" provide basic methodological tools for patent evaluation, which will help guide all parties to understand the institutional characteristics and application rules of patents, so as to achieve more comprehensive evaluation indicators and more scientific evaluation methods. Based on early pilot projects and extensive solicitation of opinions, the "Guidelines" have constructed a set of scalable and operable patent value analysis and evaluation index systems, including three first-level indicators of legal value, technical value, and economic value, and second-level indicators. 14 items, 27 third-level indicators and several extended indicators, scientifically guide the selection and weight adjustment of indicators in different scenarios such as license transfer, finance, finance and taxation, infringement relief, hierarchical management, etc., and can be used by enterprises, universities, scientific research organizations, financial institutions, Assessment agencies and other entities make selections based on actual needs and specific scenarios. On this basis, through negotiation or comprehensive market information analysis, they promote the market pricing and value realization of the patent.
In the next step, the State Intellectual Property Office will work with relevant departments to increase the promotion and implementation of the "Guidelines", promote the improvement of patent evaluation mechanisms, enhance patent evaluation capabilities, provide basic support for the transformation and application of patents, and promote the orderly flow and efficient allocation of innovation resources.
