A trademark registrant may not use a registered trademark or a registered mark on goods or services that have not been approved for use.
If another person legitimately uses the generic name, figure or model of the commodity contained in the registered trademark, or directly expresses the quality, main raw materials, functions, uses, weight, quantity or other characteristics of the commodity, or contains the geographical name; The registrant shall not prohibit the use of the shape produced by the nature of the goods in the three-dimensional mark registered trademark, or the shape of the goods needed to obtain the technical effect, or the shape of the goods with substantial value.
If another person uses a trademark identical or similar to the registered trademark on the same kind of goods or similar goods before the registration of the trademark, and has certain influence, then the user may continue to use it within the original scope of use. The registrant cannot prohibit the use of the user, but can require the user to use the registered trademark differently by adding appropriate signs.
