What are the conditions for a registered trademark to be declared invalid?

The conditions for declaring the invalidity of a registered trademark vary according to the specific reasons. If a registered trademark is declared invalid on the basis of absolute prohibition of registration, i.e. according to Article 44(1) of the Trademark Law, the Trademark Office may initiate invalidation proceedings on its own initiative ex officio, and any enterprise or individual may request the Trademark Review and Adjudication Board to make a ruling on invalidation. If a registered trademark is invalidated according to the relative prohibition clause, i.e. according to Article 45(1) of the Trademark Law, the prior right holder or interested party may request the Trademark Review and Adjudication Board to declare the trademark invalid within 5 years from the date of registration of the trademark. For registration in bad faith, the owner of a well-known trademark is not subject to the 5-year time limit.
