Q: Why did I receive a "Notice of Approval of Fee Reduction" that "does not agree to reduce payment" after submitting the application even though the filing of the fee reduction was successful?
A: One of the reasons for this situation is that the applicant omitted to fill in the applicant's ID number and other relevant information when submitting the patent application request.
Announcement No. 229 of the State Intellectual Property Office "Announcement on Adjustment of Patent Fee Reduction-Related Business Processing Mode" stipulates in Article 3: "Starting from September 1, 2016 (inclusive), the Request for Patent Application and the Request for Fee Reduction used in conjunction with the intermediary documents will be adapted and adjusted; the applicant requesting for a reduction of the patent fee in filing the patent application only needs to If the applicant requests a fee reduction when filing a patent application, the applicant only needs to check the box '□ Request for Fee Reduction and has completed the filing of the fee reduction eligibility' in the Request for Patent Application and fill in the document number of the filing of the patent fee reduction; . ......". That is to say, after the successful filing of fee reduction, the request form must fill in the "Resident Identity Card Number or Unified Social Credit Code/Organization Code" and check the box of "□ Request for Fee Reduction and Completed Filing of Fee Reduction Eligibility". After the applicant checks the box, the system will correlate the ID number or organization code with the records in the fee reduction application, and if the correlation is successful, the fee reduction will be successful.
In reality, when there is a disagreement on mitigation, usually either the applicant forgets to check the box or fails to fill in the number or code. In particular, many individual applicants sometimes omit to fill in the applicant information after filling in the inventor's resident identification number. The applicant's identity information is used to compare with the fee reduction eligibility filing system, if it is omitted, then even if the fee reduction filing is successful, it cannot be compared, and thus cannot agree to the fee reduction. Therefore, the applicant is reminded that when submitting the request for patent application, please pay attention to accurately and completely fill in the relevant information and do not omit it.
