How is the amount of compensation for patent infringement calculated?

The calculation method of compensation is based on Article 65 of the Patent Law:
(1) The amount of compensation for patent infringement shall be determined based on the losses suffered by the right holder due to the infringement;
(2) If the infringed party’s losses cannot be determined, they shall be determined based on the benefits obtained by the infringer, which may be reasonably determined by referring to a multiple of the patent license fee;
(3) If the amount of compensation cannot be determined based on the above methods, the people's court may determine the amount of compensation to be between RMB 10,000 and RMB 1 million based on factors such as the type of patent right, the nature and circumstances of the infringement.
