According to Article 4 of China's Patent Law, inventions and creations involving national security or significant interests need to apply for confidential patents in accordance with relevant regulations. Generally speaking, inventions and creations involving national defense interests mainly refer to those which are exclusively for national defense or of significant value to national defense; inventions and creations involving national security or significant interests other than national defense interests refer to those involving national defense interests other than national defense interests, the disclosure of which will affect the defense capability of the country, harm the political and economic interests of the country or weaken the economic, scientific and technological strength of the country. Inventions and creations for which a confidential patent is applied for do not include designs.
