In order to implement the "14th Five-Year Plan for the Protection and Utilization of National Intellectual Property Rights" and the Office of the Leading Group of the State Council to Promote the Development of Small and Medium-sized Enterprises, "Several Measures to Help Small, Medium and Micro Enterprises Stabilize Growth, Adjust Structure and Strengthen Capabilities" (Ministry of Industry and Information Technology Enterprise Letter [2023] No. 4) Relevant requirements, implement the relevant arrangements of the State Intellectual Property Office and the Ministry of Industry and Information Technology on "Several Measures for Intellectual Property to Support the Innovation and Development of Specialized, Specialized and New Small and Medium-sized Enterprises" (Guozhifayunzi [2022] No. 38), and benchmark against the world's advanced enterprises Management model, promote the implementation of the "Innovation Management - Intellectual Property Management Guide (ISO56005)" international standard (hereinafter referred to as the "ISO56005 International Standard"), effectively improve the efficiency and innovation level of intellectual property management of innovative entities, the State Intellectual Property Office, Industry and Information Technology The Ministry of Industry and Information Technology (hereinafter referred to as the “two departments”) decided to organize and carry out pilot implementation of international standards for innovation management of intellectual property rights. The relevant matters are hereby notified as follows:

1. Overall requirements

The ISO56005 international standard is the first international standard for intellectual property management proposed and promoted by our country. It is an important part of the international standard system for innovation management. The ISO56005 international standard takes the realization of innovation value as its core orientation, adheres to the deep integration of innovation management and intellectual property, embeds intellectual property management activities into the entire innovation process, and comprehensively improves innovation efficiency by clarifying the goals, methods and paths of intellectual property management in the innovation process. , innovation quality and innovation efficiency. Intellectual property, industry and information authorities at all levels must attach great importance to the promotion and implementation of standards, strengthen work coordination, condition guarantees and digital management, guide innovative entities to strengthen the supporting role of intellectual property in innovation, and use standardized means to improve intellectual property management capabilities and Innovation capabilities, and high-level intellectual property management to promote the maximization of innovation value.

2. Pilot Objectives

In three years, we will gradually achieve full coverage of the pilot implementation of international standards for innovation management in national intellectual property advantage demonstration enterprises and "little giant" enterprises that specialize in new technologies. The pilot enterprises have fully implemented the ISO56005 international standard, deeply integrated the innovation management system and the intellectual property management system, comprehensively improved the quality of enterprise intellectual property creation and utilization efficiency, significantly improved their innovation capabilities, and a number of innovative and intellectual property integrated management practices have emerged with demonstration effects. Cases, cultivate a number of high-value core patents that support the innovation and development of enterprises and industries, help create a number of strong intellectual property enterprises, individual champion enterprises and leading enterprises, and strongly support the construction of a manufacturing power and an innovative country.

3. Pilot content

(1) Pilot tasks

From 2023 to 2025, all provinces, autonomous regions, municipalities directly under the Central Government, cities under separate state planning, and Xinjiang Production and Construction Corps (hereinafter collectively referred to as localities) will organize a group of enterprises to carry out pilot implementation of international standards for innovation management every year, and implement the implementation of local national intellectual property advantage demonstration enterprises and local national intellectual property advantage demonstration enterprises in three batches. Full coverage of specialized and new “little giant” companies. Organize pilot enterprises to learn and implement the ISO56005 international standard and continuously improve their knowledge through the National Knowledge Management Standardization Technical Committee Standard Promotion and Application Comprehensive Service Platform (website: https://www.tc554.org.cn, hereinafter referred to as the "Comprehensive Service Platform") Regularly organize and carry out quantitative evaluations of property rights management capabilities and innovation capabilities.

(2) Pilot arrangement

1. Identify the business. The competent departments of intellectual property, industry and information technology in various regions must determine the number of enterprises to participate in the pilot each year based on local actual conditions. In principle, the number of pilot enterprises in each region in 2023 shall not be less than 1/3 of the number of local advantage demonstration enterprises and "little giant" enterprises. Focus on selecting national intellectual property advantage demonstration enterprises and "little giant" enterprises that specialize in new technologies in their respective jurisdictions, and select enterprises with good work foundations, strong innovation capabilities, and high willingness to carry out pilot projects as the first batch of pilot enterprises. Before each batch of pilot enterprises implements the standard, they must conduct an initial assessment of intellectual property and innovation capabilities on the comprehensive service platform in accordance with the unified work arrangements of the two departments (specific arrangements will be notified separately).

2. Standard implementation. The local intellectual property, industry and information technology authorities should strengthen the publicity, promotion, support and guidance of ISO56005 international standards for pilot enterprises, give full play to the online service advantages of the comprehensive service platform, and organize pilot enterprises to learn ISO56005 international standards and their authoritative interpretations, and public welfare courses through the platform , obtain free information related to standard learning and implementation, exchange and share standard implementation practice cases, keep abreast of the latest policy information on standard implementation, promote the close integration of intellectual property and innovation whole-process management of pilot enterprises, and continuously improve and enhance intellectual property management capabilities and innovation capabilities. At the same time, rely on the comprehensive service platform to track and understand the learning status and related needs of pilot enterprises to improve the scientificity and effectiveness of standard implementation.

3. Stage evaluation. Each year, the two departments will organize annual data submissions related to intellectual property rights and innovation capabilities through a comprehensive service platform for all enterprises participating in the pilot, comprehensively evaluate the overall improvement of intellectual property rights and innovation capabilities of enterprises in various regions, and evaluate the effectiveness of the pilot implementation work in various regions. The data reported by the pilot enterprises will be simultaneously used for the selection and review of national intellectual property advantage demonstration enterprises. The local intellectual property, industry and information technology authorities should actively cooperate with the two departments to organize pilot enterprises to fill in data, focus on collecting and summarizing pilot experience and typical cases from pilot enterprises in different industrial fields and different stages of development, and provide timely feedback on problems and suggestions discovered during the pilot.

4. Safeguard measures

(1) Strengthen organizational management. The two departments will strengthen the overall arrangement of the pilot work for the implementation of international standards for innovation management, and jointly provide business guidance, platform construction, stage evaluation and information sharing for the pilot. The local intellectual property, industry and information technology authorities must strengthen work coordination and provide good selection, organization and mobilization, policy support and follow-up services for pilot enterprises.

(2) Improve supporting policies. Local intellectual property, industry and information authorities should make full use of special funds for the development of small and medium-sized enterprises, intellectual property-related funds, etc. to provide support for the implementation of pilot projects for the implementation of international standards for innovation management, and actively guide pilot enterprises to learn and implement the ISO56005 international standard.

(3) Strengthen platform support. The local intellectual property, industry and information technology authorities should regard the comprehensive service platform as an important starting point and digital guarantee for serving innovation entities, promoting the implementation of standards and continuously improving innovation capabilities, and promptly collect feedback on platform construction and optimization suggestions. The two departments will continue to improve the functions of the comprehensive service platform based on the needs of the pilot work, promptly summarize and provide feedback on the implementation of standards in various places, and promote the joint construction, co-governance, and sharing of the comprehensive service platform.

(4) Increase publicity and promotion. The competent departments of intellectual property, industry and information technology in various places should encourage pilot enterprises to conduct pilot projects and summarize their experience, and publicize and promote the implementation experience of international standards for innovation management to enterprises upstream and downstream of the industrial chain and enterprises in the industry, so as to further expand the influence and influence of the pilot projects. cover area. The two departments will actively create conditions to promote the units where relevant practical cases are located to participate in the development of relevant international standards.

The competent authorities of intellectual property, industry and information technology in all regions are requested to launch the pilot as soon as possible in accordance with the requirements of the notice. Before June 30, they shall formulate and issue local (including cities under separate state planning) work plans, determine the list of the first batch of pilot enterprises in various places, and submit the work plans, enterprises The list and contact information of the local intellectual property, industry and information technology authorities shall be submitted to the two departments for filing. In 2024 and 2025, the lists of the second and third batch of pilot enterprises must be submitted to the two departments for filing before March 31 of that year respectively.
