Your proposal to include Patent Intelligence Analysts in the List of National Professional Qualifications (Level Assessment category) has been received. Based on the views of the Ministry of Human Resources and Social Security, my reply is as follows.

First, the construction of patent intelligence analysts related talent team evaluation mechanism

Intellectual property owners are the first resource for the development of intellectual property, the prerequisite for high-quality development of intellectual property, and the strategic support for building an intellectual property power. In recent years, the development of China's intellectual property industry has accelerated, the work of intellectual property personnel has successfully completed the work target of the "13th Five-Year Plan" period, the system, mechanism and policy environment for the development of intellectual property personnel have been continuously optimized, and the national intellectual property personnel team has grown rapidly, reaching 690,000 people. The bureau attaches great importance to the construction of various intellectual property talents, and specifically emphasizes in the "14th Five-Year Plan for intellectual Property Talents" that it is necessary to "strengthen the training of patent navigation talents, gradually improve the work level of patent navigation talents", "increase the training of intellectual property information service talents, and improve the ability of intellectual property information retrieval and intelligence analysis of talents".

Talent evaluation is an important part of talent development system and mechanism. Previously, in order to further improve the evaluation method of intellectual property talents, the Bureau actively promoted the addition of the sub-category of "intellectual property professionals" in the Occupational Classification of the People's Republic of China (2015 edition), and set up eight occupational categories including "patent information analysis professionals". In 2021, the Bureau organized research and demonstration by industry experts, proposed to the Office of the Revision Committee of the National Occupational Classification Convention that the "patent information analysis professionals" be amended to "intellectual property information analysis professionals", and modified their occupational definition, improving and enriching the main work tasks as "1. Retrieval, screening, processing and analysis of intellectual property information; 2. Conduct navigation analysis of industrial patents, plan the direction and path of innovation development; 3. Excavate and analyze the legal, technical and economic value of intellectual property information disclosure; 4. Drawing patent maps, analyzing the development and competition situation in the technical field, judging and warning patent risks; 5. Analyze and evaluate the use value and market role of intellectual property rights; 6. Provide consulting services in the search and analysis of intellectual property information ".

The Ministry of Human Resources and Social Security has always attached great importance to the construction of intellectual property personnel. In June 2019, it issued the Guiding Opinions on Deepening the Reform of the Title System of Economic Professionals, which clearly regards intellectual property as an independent profession in the economic series. The title of intellectual property professional is directly named as assistant intellectual property engineer, intellectual property engineer, senior intellectual property engineer, and senior intellectual property engineer, so as to further reflect professional attributes and enhance professional identity of intellectual property talents. Qualified patent information analysis professional and technical personnel may participate in the economic professional and technical qualification examination organized by the State, and may also apply for the evaluation of professional titles in accordance with the provisions. At the same time, the Ministry of Human Resources and Social Security supports the dynamic adjustment of professional Settings in all localities, and the addition of new majors in intellectual property and other fields with good development momentum and high demand for evaluation.

Second, on the "Patent intelligence analysts included in the national professional qualifications (level assessment category) directory"

In 2017, with the consent of The State Council, the Ministry of Human Resources and Social Security issued the Notice on the Publication of the Catalogue of National Vocational Qualifications, which clearly set the vocational qualifications of level evaluation, and the occupations (types of work) involved should have strong professionalism and social versatility, high technical skills requirements, and are really needed for industry management and talent team construction. The establishment of new vocational qualifications shall be reported to The State Council for approval in accordance with the procedures. Whether patent intelligence analysts have the conditions for new professional qualifications, they must, together with the relevant departments of The State Council, organize experts to fully study and demonstrate and widely listen to opinions and suggestions from all aspects.

In the next step, the Ministry of Human Resources and Social Security will actively study the actual situation of the patent information analysis industry and the needs of practitioners, further refine and optimize the evaluation criteria for intellectual property professionals, strengthen the construction of intellectual property personnel, and better meet the needs of economic and social development.
