State Intellectual Property Office: Starting from January 1, 2023, invention patent applications from Hong Kong SAR applicants can receive priority examination in the mainland

Starting from January 1, 2023, permanent residents of the Hong Kong Special Administrative Region, companies established in accordance with the Companies Ordinance of the Hong Kong Special Administrative Region and other legal entities or organizations of the Hong Kong Special Administrative Region can register through the Guangzhou Agency and the Shenzhen Agency of the Patent Office of the State Intellectual Property Office. Submit relevant application materials so that invention patent applications that meet relevant conditions can receive priority examination in the Mainland.
In order to thoroughly implement the central government’s decision-making and deployment on promoting the construction of the Guangdong-Hong Kong-Macao Greater Bay Area and support Hong Kong SAR residents to more conveniently and effectively protect their intellectual property rights in the mainland, the State Intellectual Property Office will use the form of a pilot project to apply for Hong Kong SAR applicants’ invention patents in the mainland. Make convenient arrangements for priority review.
According to the pilot project, starting from January 1, 2023, permanent residents of the Hong Kong Special Administrative Region, companies established under the Companies Ordinance of the Hong Kong Special Administrative Region and other legal entities or organizations of the Hong Kong Special Administrative Region can register through the Patent Office of the State Intellectual Property Office in Guangzhou. The agency and the Shenzhen agency submit relevant application materials so that invention patent applications that meet relevant conditions can receive priority review in the mainland.
The invention patent applications applicable to this pilot project must be the invention patent applications of Hong Kong SAR applicants that are in the substantive examination stage in the mainland, and their technical fields fall within the technical fields of the "Administrative Measures for Patent Priority Examination" (State Intellectual Property Office Order No. 76) , the relevant application classification numbers fall into the scope of the "Reference Table of Strategic Emerging Industries Classification and International Patent Classification (2021)".
Hong Kong SAR applicants can submit patent priority examination application materials to the Guangzhou Agency of the Patent Office of the State Intellectual Property Office or the Shenzhen Agency of the Patent Office of the State Intellectual Property Office in person or by mail, but they cannot submit the same application materials to the two agencies repeatedly.
