In the governance of platform-type trademark agencies, the State Intellectual Property Office has constantly innovated regulatory methods, explored the establishment of a "settlement-type" regulatory mechanism, and improved regulatory efficiency through a full range of "mentoring" inspection and supervision. The main measures taken are as follows: First, change the concept and break the "antagonism" of regulatory sentiment. Adopt a "coaching" governance approach, break the regulatory approach with administrative penalties as the main way, establish a compliance department within the platform trademark agency, and change from "want to check me" to "I want to check". The second is to focus on risks and highlight the "prevention in advance" of the regulatory process. In view of the business model and main risks of platform-based trademark agencies, the existing problems are sorted out in detail, and the working mechanism of malicious application screening, malicious application notification, conflict of interest review, and online application de-verification is guided to be established and improved. The third is to strengthen the organization and break the "single" regulatory force. The key forces of the relevant business departments of the State Intellectual Property Office, local intellectual property offices and industry associations have been deployed to form a working group, and a team of experts from multiple departments such as supervision, review, informatization, and industry self-discipline has been established to improve the pertinency and effectiveness of regulatory rectification opinions and ensure the maximum effect of supervision.
In the next step, the State Intellectual Property Office will comprehensively use various measures to continue to strengthen supervision, so that platform-type trademark agencies can achieve strict quality management and law-abiding and standardized operation, and promote the healthy and orderly development of the new business of agency services.
