Your proposal on Increasing the National Intellectual Property Work budget has been received. Based on the views of the Ministry of Finance, my reply is as follows:

I. On increasing the financial budget for intellectual property issues

(1) The Intellectual Property Office shall establish soft science research projects. In order to strengthen and improve intellectual property investigation and research work and support scientific decision-making, the Bureau has set up a special soft science research project, which has been carried out for 23 consecutive years, forming a batch of research results, compiling and publishing 11 volumes of excellent investigation and research reports, providing strong support for the in-depth implementation of intellectual property strategy and accelerating the construction of intellectual property power. In terms of project scale and supporting funds, in recent years, in order to implement the requirements of "tight days", the funding for soft science research projects has been reduced, and 21 projects have been approved in 2021, with each support fund of 50,000 yuan. In order to better improve the efficiency of the use of project funds and promote the application of results, the "Management Measures for Soft Science Research Work" and "Procedures for Soft Science Research Work" are revised in time to further improve the scientific and standardized level of project management. In terms of research content, the scope of intellectual property soft science research mainly includes intellectual property strategy, policy, planning, management, system reform, laws and regulations, talent work, cultural construction, international competition and other contents. In the past five years, the research has focused on the management and operation of intellectual property results. Set up 23 related topics such as "Research on ownership, disposal, transformation and management of intellectual property rights of financial funded projects", accounting for 15%; Focusing on the innovation and development of traditional pillar industries, 11 related topics such as "Big data analysis and policy research on emerging industrial technology patents in the chemical field" were set up, accounting for 7.3%. In terms of research subjects, it adopts the method of public recommendation and declaration, and carries out the review and approval work in accordance with the principles and procedures of fairness, justice and openness as well as relevant standards, and does not limit the nature of the undertaking units and cooperative units. In the past five years, 18 topics have been undertaken by enterprises, patent agencies and other practical subjects, accounting for 12%.

(2) The Ministry of Finance provides support through the Social Science Fund and other funds. The Ministry of Finance supports basic, strategic and cutting-edge research on intellectual property rights through the National Social Science Foundation's "Research on Legal Conflicts and Resolution of Civil Criminal Protection of Intellectual Property Rights" and other projects. Through basic operating funds and basic research expenses, the Chinese Academy of Social Sciences and other research institutes are supported in carrying out independent research on topics related to intellectual property. In the next step, we will further play our functional role and continue to do relevant work through existing channels. The Bureau will further improve the efficiency of the use of intellectual property policy research funds, increase research efforts in promoting the operation of intellectual property results and the development of traditional pillar industries, support more innovative entities such as enterprises to participate in research work, improve the quality of research results, and provide more strong support for the high-quality development of intellectual property undertakings.

Second, on the cultivation of national intellectual property advantage enterprises and demonstration enterprises

(1) Starting the declaration of national intellectual property advantages and demonstration enterprises. In the past two years, our bureau has summarized and condensed the pilot demonstration work in the early stage, selected a number of typical cases of advantageous demonstration enterprises, strengthened publicity and promotion, and helped more enterprises to effectively enhance their core competitiveness by using intellectual property rights. On the basis of comprehensively upgrading the original pilot demonstration work mechanism, content, form, etc., in May 2022, a notice was issued for enterprises to carry out demonstration work on the construction of intellectual property power. At present, all localities are actively participating in the declaration and review of national intellectual property advantages and demonstration enterprises according to the requirements of the circular.

(2) The demonstration enterprises will be included in the China Patent Award recommendation channel. Since the "13th Five-Year Plan", the China Patent Award has selected more than 7,000 patent projects with high creative quality, good application efficiency and strong demonstration effect, giving full play to the important role of intellectual property rights in stimulating innovation at home and promoting opening-up to the outside world. The selection of China Patent Award adopts the recommendation method to declare, and since the selection of the 16th Patent Award in 2014, national intellectual property demonstration enterprises have been added as a recommendation channel. In the 23rd Patent Award selection in 2021, more than 300 demonstration enterprises participated in self-recommendation and recommended a number of high-value patents.

(3) Provide support through special funds. In order to speed up the transfer and transformation of patents and smooth the connection between the supply and demand of technology elements, from 2021 to 2023, the central finance will support the implementation of a special plan for patent transformation through the service industry development fund, focusing on supporting the opening of patent information and the supply of intellectual property operation services, docking the patent technology needs of small and medium-sized enterprises, and helping small and medium-sized enterprises to innovate and develop. According to the current regulations, for the evaluation and recognition of supporting fund awards, it is necessary to apply for approval according to the procedure, and the Ministry of Finance will consider it overall.

In the next step, the Bureau will continue to do a good job in the selection and review of national intellectual property advantages and demonstration enterprises, further smooth the application channels of demonstration enterprises in the selection of China Patent Award, adhere to the high-quality development orientation, select more high-value core patents, better play the demonstration-oriented role of China Patent Award, and stimulate the innovation vitality of the whole society.
