On October 8, in order to further increase the crackdown on illegal and untrustworthy behaviors of intellectual property agencies, comprehensively use credit supervision methods, strengthen the supervision of intellectual property agencies, and build a long-term mechanism to promote the healthy and orderly development of the intellectual property agency industry, The State Intellectual Property Office formulated the "Patent Agency Credit Evaluation Management Measures (Trial)" in the early stage, and revised the "Patent Agency Credit Evaluation Management Measures (Public Comment Draft)" based on the trial run in pilot provinces. The "Measures" are now 》Openly solicit opinions from the public. It is mentioned that credit points will be deducted for abnormal patent applications! And the frequency of inspections can be reduced for specialized agencies and patent attorneys that have reached the "A+" or "A" level.

According to the credit score index system and score rules for patent agencies and agents:

Agent for abnormal patent applications:

1. If the applicant is found to have acted as an agent for abnormal patent applications and has not yet been punished, 0.5 points will be deducted for each case, with a maximum deduction of 20 points;

2. If you act as an agent for abnormal patent applications notified by the State Intellectual Property Office, if there are serious circumstances such as a large number of agents, repeated agents, etc., if the rectification is not in place and you have not been punished, 10 points will be deducted;

3. Those who are found to have acted as agents for abnormal overseas patent applications will be deducted 1 point for each application, with a maximum deduction of 20 points; those who have caused major international adverse effects and refuse to withdraw will be deducted a maximum of 40 points.

The total of the above three items will be deducted up to 40 points.

(The maximum deduction is 20 points before abnormal revision and the maximum deduction is 40 points after revision)

It is also mentioned that for patent agencies and patent attorneys that have reached the "A+" or "A" level, the State Intellectual Property Office and the patent management departments of the people's governments of provinces, autonomous regions, and municipalities directly under the Central Government can reduce the frequency of daily inspections, and in the relevant administrative We will provide them with facilitation services in the process of review and approval, and give priority to acceptance and review in applications for fiscal capital projects and the filing of relevant review facilitation measures.
