The patent war between Ningde Times (300750.SZ) and rival China Chuang Singapore Airlines has intensified, involving claims of more than 640 million yuan. On August 1, Ningde Times confirmed to Jiemian News that the company has filed a new patent infringement lawsuit against Zhongchuang Singapore Airlines, claiming 130 million yuan, and the Fujian Provincial High Court has now accepted the case. At the same time, Ningde Times also sued the court on the grounds of unfair competition.

The patent war between Ningde Times (300750.SZ) and rival China Chuang Singapore Airlines has intensified, involving claims of more than 640 million yuan.

The patent battle between the two began last July. In the same month, Ningde Times submitted an indictment on the patent infringement case of Zhongchuang New Airlines, and was accepted by the Fuzhou Intermediate People's Court. According to Ningde Times, the patents involved involve invention and utility model patents, and the batteries suspected of patent infringement have been carried on tens of thousands of vehicles.

At the time, the company responded that it insisted on independent research and development, and the products it provided to customers had undergone a comprehensive risk investigation by a professional intellectual property team, and was convinced that its products did not infringe on the intellectual property rights of others.

Zhongchuang Airlines has since disclosed that Ningde Times sued the company for infringement of a total of five battery-related patents, involving positive electrode sheets and batteries, explosion-proof devices and other technologies.

The rise of second-line battery companies

Rewrite the competitive landscape of one dominant company

Ningde Times asked Zhongchuang New Aviation to stop manufacturing and selling the above-mentioned infringing products, and claimed 185 million yuan from it. At the same time, Zhongchuang Airlines was also ordered to pay 3 million yuan to bear the costs of Ningde Era to stop the infringement.

At present, the main business of Ningde Times and ZhongChuang Xinhang is the power battery used in new energy vehicles. According to the latest power battery statistics released by the South Korean research institution SNE, the installed battery capacity of Ningde Era in the first half of 2022 is 69GWh, ranking first in the world, and the market share reaches 34.8%. Among the top ten enterprises, there are 6 Chinese enterprises, with a cumulative market share of 56.4%. Among them, Zhongchuang Airlines ranked seventh in the world with a market share of 4.1%, and the installed battery capacity in the first half of the year was 9GWh.

The airline filed a prospectus with the Hong Kong Stock Exchange in March to list in Hong Kong. The rise of second-tier battery companies is rewriting the competitive landscape of a dominant company.

At the AVIC lithium battery strategy conference in November last year, Liu Jingyu, chairman of Zhongchuang New Aviation, announced that the company raised the target capacity of power batteries in 2025 to 500GWh, and the capacity is expected to reach 1000GWh in 2030.

The five patents involved are invalid

After Ningde Times filed a patent infringement lawsuit in July last year, China Innovation Airlines immediately filed an application with the State Intellectual Property Office to invalidate the five Ningde Times patents involved in the lawsuit.

According to the information of the State Intellectual Property Office, among the five patents in dispute between the two parties, Zhongchuang Singapore Airlines has previously withdrawn one of the patent invalid applications, and the other two of the five were also judged by the State Intellectual Property Office to "maintain the validity of the patent right" and "the patent right is partially valid". With the active withdrawal of one case by China Innovation Singapore Airlines, only one case of patent dispute between the two sides remains to be decided.

The State Intellectual Property Office has decided to review two of the invalid applications. A patent is maintained in full force and a patent is maintained in part force. The company had withdrawn invalidation requests for three other patents, although it filed new invalidation requests for those three patents this month.

Ningde Times confirmed to the interface news that it has received new invalid requests from Zhongchuang New Airlines for the three patents involved in the lawsuit. At the same time, the company said that China Innovation Airlines had previously made five patent invalidation requests, and none of them were successful, and the court has begun the substantive trial stage.

Zhongchuang Singapore Airlines later issued a statement saying that at present, the two companies' lawsuits and the invalidity of the patents involved are still in the trial stage, and there is no effective judgment.

With the development of the new energy industry in full swing today, the value of patents is becoming more and more important. Enterprises that take the lead in establishing a moat through investment can also use patent income to feed research and development to achieve a virtuous cycle. Latecomers either invest large costs in research and development to find a new path, or choose to cross patents with other enterprises, or purchase the right to use patents.

In the field of power battery patents, domestic enterprises have come and gone, and in some areas have achieved corner overtaking of Europe, the United States, Japan and South Korea.

In the future, research and development and innovation are the two key to the high-quality development of lithium battery enterprises, the market position of Ningde era is stable as a rock, after the country xuan, Honeycomb and other soldiers, in order to maintain a competitive advantage, it is necessary to build a moat such as research and development. Relying on low prices to grab the market, sacrificing short-term profits and research and development investment, in exchange for survival time and space is not a long-term solution.

The patent dispute has laid a hidden danger for the IPO road. Listing has always been a solid foundation, enterprises only adhere to long-term independent innovation, in order to climb the slope, development and growth, boost the high-quality development of China's new energy vehicles.
