In accordance with the provisions of the Patent Law, the Patent Agency Regulations and relevant departmental regulations, matters related to the 2022 Patent Agent Qualification Examination are now announced as follows:

1. Registration

(1) Registration conditions

1. Have full capacity for civil conduct;

2. Obtain a nationally recognized college degree or above in science and engineering, and obtain a diploma or degree certificate.

(2) Test center setting

The 2022 Patent Agent Qualification Examination will be held in 32 mainland cities and the Hong Kong Special Administrative Region. The mainland exam centers are Beijing, Tianjin, Shijiazhuang, Taiyuan, Hohhot, Shenyang, Changchun, Harbin, Shanghai, Nanjing City, Suzhou City, Hangzhou City, Hefei City, Fuzhou City, Nanchang City, Jinan City, Qingdao City, Zhengzhou City, Wuhan City, Changsha City, Guangzhou City, Nanning City, Haikou City, Chongqing City, Chengdu City, Guiyang City , Kunming City, Xi'an City, Lanzhou City, Xining City, Yinchuan City and Urumqi City.

Applicants can choose a test center to take the test based on their own circumstances when registering.

Applicants from the Hong Kong Special Administrative Region can choose to take the exam in the Hong Kong Special Administrative Region, Beijing, Shanghai, Guangzhou, and Fuzhou. Applicants from the Macao Special Administrative Region and Taiwan can choose to take the exam in Beijing, Shanghai, Guangzhou, and Fuzhou.

(3) Registration procedure

Applicants for the Patent Agent Qualification Examination should register through the registration system in the special column of the "Patent Agent Qualification Examination" on the State Intellectual Property Office government website (http://www.cnipa.gov.cn). Registration is divided into three steps: pre-registration, qualification review, and payment confirmation. The intellectual property administrative department of the province (autonomous region, municipality directly under the Central Government) where the test center city is located (hereinafter referred to as the intellectual property administrative department of the test center) is responsible for registration matters. The Examination Center of the Vocational Training Council's Peak Continuing Education Institute is responsible for registration matters for the examination center in the Hong Kong Special Administrative Region.

1. Pre-registration. Applicants should pre-register through the registration system from 8:00 on July 4, 2022 to 17:00 on July 22, and no additional registration will be made after the deadline. Applicants who apply for exemption from the patent agency practical subject examination should also apply within the above time. Follow the guidelines of the registration system to fill in the registration information truthfully and accurately, upload relevant materials, and promise to be responsible for their authenticity.

2. Qualification review. After successful pre-registration, the intellectual property administrative department of the examination center will review the qualifications of the applicants. Applicants should actively cooperate and make corrections in a timely manner if there are any errors in the registration information. The qualification review period is from July 4 to July 29, 2022. If you fail to complete the modification and correction of the registration information as required within the time limit, you will be deemed to have failed the review. The Examination Center of the Vocational Training Council's Peak Continuing Education Institute is responsible for the qualification review of the examination centers in the Hong Kong Special Administrative Region.

3. Payment confirmation. Applicants who pass the qualification review should pay the examination registration fee to the intellectual property administrative department of the selected examination center according to the registration system prompts. The deadline for online payment is 15:00 on August 5, 2022.

The examination center in the Hong Kong Special Administrative Region implements on-site payment. The payment location is: the Examination Center of the Peak Continuing Education Institute on the first floor of the Vocational Training Council Building, 27 Wood Road, Wan Chai. The payment deadline is 20:00 on August 5, 2022.

Applicants will only be confirmed to have completed the registration process after paying the examination registration fee in full and on time. If the registration fee is late or not paid in full, the registration will be deemed incomplete. Once paid, the registration fee is non-refundable. After payment is confirmed, registrants are not allowed to change the test location. Registration is regarded as submitting a pre-application for patent attorney qualification.

(4) Registration materials

When registering, applicants should fill in or upload the following materials:

1. 2022 Patent Agent Qualification Examination Registration Form and Patent Agent Qualification Pre-Application Form.

2. Scanned copy of my valid ID card.

Applicants should upload a scanned copy of their resident ID card or passport of the People's Republic of China when registering.

Applicants from the Hong Kong Special Administrative Region should upload a scanned copy of their Hong Kong permanent resident identity card, as well as a scanned copy of the Mainland Travel Permit (Home Return Permit) for Hong Kong and Macao residents or the passport of the Hong Kong Special Administrative Region of the People's Republic of China.

Applicants from the Macao Special Administrative Region should upload a scanned copy of the Macao permanent resident identity card, as well as a scanned copy of the Mainland Travel Permit (Return Permit) for Hong Kong and Macao residents or the passport of the Macao Special Administrative Region of the People's Republic of China when registering.

When registering, applicants from Taiwan should upload a scanned copy of the Mainland Travel Permit for Taiwan residents and a scanned copy of the Taiwan resident ID card. If you cannot upload the mainland travel permit for Taiwan residents, you should upload the Taiwan resident identity card and household registration transcript or household register.

3. Scanned copy of my academic qualification/degree certificate.

Applicants should upload a scanned copy of their academic qualifications/degree certificate or an electronic copy of the certification from the China Higher Education Student Information Network or the electronic copy of the certification from the China Degree and Graduate Education Information Network.

Those who apply with academic degree certificates from the Hong Kong Special Administrative Region, Macao Special Administrative Region, Taiwan or foreign higher education institutions should upload a scanned copy of the academic degree certificate from the Study Abroad Service Center of the Ministry of Education. If the academic qualification or degree certificate is in a foreign language, it must be accompanied by a Chinese translation, and the Chinese translation does not need to be notarized.

4. An electronic copy of my ID photo taken in the past three months with a color blue background and a front face without a hat. Specific requirements are as follows:

(1) Photo size is 48mm×33mm, portrait head width is 21mm-24mm, head length is 28mm-33mm;

(2) Electronic document requirements: JPG format, file size between 30k-120k, resolution 300dpi, width: 390 pixels, height: 567 pixels.

This photo will be the only photo used for my qualification review, admission ticket, and patent agent qualification certificate. In order to ensure the accuracy of image recognition, the background color of the photo should be consistent with the requirements of the standard blue background ID photo, and severely stretched photos are not allowed.

5. Scanned copy of "Letter of Commitment for Patent Agent Qualification Application". Applicants should download the electronic copy of the "Letter of Commitment for Patent Agent Qualification Application" from the registration system, sign it and upload the scanned copy.

(5) Select the test station

Applicants should log in to the registration system to select the test station from 8:00 on September 29 to 17:00 on October 7, 2022. The test station is based on the number of test seats, and the selection is completed in order. If the reservation is full, it will be unselectable.

(6) Admission ticket

Applicants should log in to the registration system between 8:00 on October 31, 2022 and 13:00 on November 6, 2022 to print out their admission tickets. The admission ticket contains the personal information of the applicant and the examination time, subjects, location and other contents.

2. Examination

(1) Exam date and location

The 2022 Patent Agent Qualification Examination is scheduled to be held simultaneously in all examination center cities on November 5th and 6th.

(2) Exam subjects and time

The patent agent qualification examination implements a national unified proposition, and the scope of the proposition is based on the "2022 Patent Agent Qualification Examination Outline". The outline will be published on the government website of the State Intellectual Property Office.

The exam is divided into three subjects. The names of each subject and the exam time schedule are as follows:

Patent legal knowledge: November 5, 9:00-11:30;

Relevant legal knowledge: November 5, 14:00-16:00;

Patent agency practice: November 6, 9:00-13:00.

(3) Examination question types and examination methods

The patent agent qualification examination is a closed-book examination. The questions in the two subjects of patent legal knowledge and related legal knowledge are multiple-choice questions. The questions in the patent agency practice subject are essay answers and practical writing.

The Patent Agent Qualification Examination adopts a computerized examination method, which refers to the method in which candidates obtain patent legal knowledge, relevant legal knowledge and patent agency practical subjects test questions on a computer terminal, answer all subjects on the computer terminal and submit the answer results.

The examination questions are in simplified Chinese characters, and test takers from the Hong Kong Special Administrative Region, Macao Special Administrative Region, and Taiwan can use traditional Chinese characters to answer questions. When answering questions, they should use professional terms stipulated in national laws, regulations and rules.

(4) Announcement and review of examination results

The Patent Agent Qualification Examination will be graded uniformly across the country, and the exam results will be announced after the marking is completed. Test takers can check their scores within the specified period through the registration system.

Starting from 2020, the State Intellectual Property Office will no longer make public examination questions and reference answers. If test takers believe that their test scores are obviously abnormal, they may apply for rechecking their scores within the specified period after the test results are announced. The review of test scores is limited to rechecking whether the sum of the scores for each question is correct. Test takers are not allowed to access the original data of their test papers. The results of the score review will be notified by the Office of the Patent Agent Examination Committee through the registration system to the candidates who applied for score review.

3. Grant of Patent Agent Qualification

(1) Determine the passing score line according to actual needs

After the exam, the Patent Agent Examination Committee will discuss and determine the passing score line based on the actual needs of patent work and the difficulty of the exam questions that year, and announce it.

(2) Application for patent agent qualification

From the date of announcement of passing scores, pre-applications for patent agent qualifications for those who pass all examination subjects within the specified time will automatically be converted into formal applications and become effective. After verifying the registration information of the person mentioned, the State Intellectual Property Office will grant the patent agent qualification and issue the "Patent Agent Qualification Certificate".

The patent agent qualification certificate is uniformly produced by the State Intellectual Property Office and issued by the intellectual property administrative department of the examination center.

4. Other examination matters

The State Intellectual Property Office does not organize pre-examination training classes, and training organizers are not allowed to organize or hold training classes or conduct relevant publicity in the name of the State Intellectual Property Office.

The 2022 Patent Agent Qualification Examination public consultation telephone number, each examination center, and the contact information of the Intellectual Property Department of the Hong Kong Special Administrative Region Government and the Economic Bureau of the Macao Special Administrative Region Government will be published on the government website of the State Intellectual Property Office.
