Case background

According to a lawsuit filed by Adidas in the federal court in eastern Texas on June 10, it accused Nike of infringing on nine of its patents, including the Nike Run Club, Training Club and SNKRS applications and Adapt system. Adidas claimed that Adant infringed on the 2005 Adidas sneakers, which were the world's first smart running shoes and could adjust the comfort of the shoes while the shoes were being worn.

In addition, Adidas Confirmed and Nike SNKRS also have similar characteristics. Confirmed debuted in February 2015, and SNKRS was launched in May 2015. In the lawsuit filed, it stated: "Adidas has long been a leader in mobile technology (Mobile Technology). A leader in technologies related to mobile fitness and mobile purchasing, Adidas is also the first company in the industry to provide comprehensive data analysis for athletes."

 

Specific items of accusation

1. The Nike Adapt system infringes on the adidas 1 shoe model launched by adidas in 2004, which "can sense and adjust the comfort of the shoe while wearing it";
2. Nike’s Run Club, Training Club and other apps infringe adidas’ patents in tracking and storing activity-related progress, performance feedback, and personalized guidance and training techniques;
3. The SNKRS app infringes Adidas’ patent that allows users to “reserve and purchase limited edition sneakers” on the Confirmed app.

 

Everything happens for a reason

This move is not so much Adidas suing Nike as it is Adidas's counterattack. Because on December 13 last year, Nike asked the U.S. International Trade Commission to block the import of many Adidas sports shoes on the grounds that they infringed on its own Flyknit flying line design technology. (Nike requires Adidas series models to be banned from entering the United States)

Nike said in a complaint filed last year that 49 Adidas shoes use PrimeKnit technology, which infringes on six of Nike's patents. The Adidas shoes considered to be infringing include casual shoes, football shoes, running shoes, and hiking shoes. Involving Ultraboost, Terrex, X Speedflow and other product lines.
