The 2021 China Patent Survey Report was released

Recently, the State Intellectual Property Office released the 2021 China Patent Survey Report (hereinafter referred to as the "Report"). According to the survey data, at this stage, China's patent transfer and transformation status remains active, the industrialization rate of effective invention patents continues to increase, the cooperation between industry, university and research has achieved remarkable results, and the domestic intellectual property protection environment is stable and improving.

First, the industrialization rate of effective invention patents in our country increases steadily. In 2021, the industrialization rate of China's invention patents was 35.4%, an increase of 0.7 percentage points over the previous year, which showed an upward trend in the past three years and stabilized at more than 30% in the past five years. As the main body of innovation, the industrialization rate of effective invention patents of enterprises reached 46.8%, an increase of 1.9 percentage points over the previous year. From the perspective of enterprise size, the industrialization rate of invention patents of large, medium and small enterprises reached 47.1%, 54.6% and 47.7%, respectively, which increased from the previous year.

Second, industry-university-research cooperation effectively promotes the level of patent industrialization. The survey shows that the industrialization rate of invention patents with universities as the first patentee reaches 22.8%, which is more than seven times the average level of universities. The industrialization rate of invention patents with scientific research institutions as the first patentee was 25.8%, about 10 percentage points higher than the average level of scientific research institutions. The data also show that the average return on the industrialization of invention patents in industry-university-research cooperation exceeds the average level of enterprises by 32.5%, and the effect of industry-university-research cooperation on improving economic benefits is obvious.

Third, China's intellectual property protection environment is improving overall. In 2021, the proportion of Chinese enterprises taking rights protection measures after experiencing patent infringement was 76.4%, an increase of 2.5 percentage points over the previous year, and enterprise patentees were more active in responding to patent infringement. The proportion of the court's judgment of compensation, litigation mediation or court settlement amount of more than 1 million yuan in China's patent infringement litigation cases was 16.3%, 9.0 percentage points higher than the previous year, indicating that the cost of intellectual property infringement in China is constantly increasing.

The person in charge of the Strategic Planning Department of the State Intellectual Property Office said that in order to implement the work deployment of the "14th Five-Year Plan for the Protection and Application of National Intellectual Property Rights" on "strengthening the investigation of the effectiveness of intellectual property transfer and transformation", the patent investigation work in 2021 further optimized the investigation program, and carried out key thematic analysis in terms of patent industrialization rate and its income, and patent protection. The Report has been publicly released to the public for the sixth consecutive time, providing strong data support for relevant policy decisions, and also becoming an important window for the public to understand the development of China's intellectual property cause.

Since 2008, with the promulgation and implementation of the Outline of the National Intellectual Property Strategy, China's patent investigation has come into being and has been carried out for 15 consecutive years. Over the years, with the strong support of local intellectual property management departments and investigation subjects at all levels, the investigation work has been deepened and improved. During the "12th Five-Year Plan" period, the investigation contents gradually expanded to the whole chain of patent creation, application, protection, management and service, patent sampling expanded from authorized patents to valid patents, and successively carried out key investigations for PCT patent applications, central enterprises, and strategic emerging industries. Since the "13th Five-Year Plan", the investigation and release mechanism has been continuously improved. Since it was first published in 2016, China's patent investigation report has attracted wide attention both at home and abroad. The investigation conclusions have been quoted by the World Intellectual Property Organization, the survey results have been reported many times by People's Daily, Xinhua News Agency and other media, and the investigation analysis content has been adopted by the national paper of the Chinese language of the college entrance Examination, which has played a positive role in promoting the popularization of the patent system and enhancing the awareness of innovation in the whole society.
