One picture to understand | A brief introduction to EU industrial design applications

随着中国经济的迅猛发展，来自中国的欧盟商标和外观设计申请需求也在持续增长。针对这种情况，欧盟知识产权局（EUIPO）在2021年发布了关于欧盟商标和外观设计申请的中国专题报道。EUIPO官方数据显示，2010-2019年间，来自中国的欧盟外观设计专利申请总量达到56846件，年平均增长率为31.4%。其中2019年与2010年相比增长890.4%，并在2020年疫情以来延续了增长趋势。这说明中国创新主体的知识产权意识不断增强，越来越重视设计类知识产权的法律保护。本报告主要从欧盟外观设计概况、定义、授权条件、注册程序以及费用四个方面进行分析，供有关政府部门及相关企业参考。
With the rapid development of China's economy, the demand for EU trademark and design applications from China continues to grow. In response to this situation, the European Union Intellectual Property Office (EUIPO) released a special report on EU trademark and design applications in China in 2021.
EUIPO official data shows that between 2010 and 2019, the total number of EU design patent applications from China reached 56,846, with an average annual growth rate of 31.4%. Among them, the growth rate in 2019 was 890.4% compared with 2010, and the growth trend has continued since the epidemic in 2020. This shows that the awareness of intellectual property rights among Chinese innovation entities is constantly increasing, and they are paying more and more attention to the legal protection of design intellectual property rights.

1. Overview of EU industrial designs
On December 12, 2001, the Council of the European Union adopted the Council Regulation (EC) No 6/2002 of 12 December 2001 on Community designs (hereinafter referred to as the "Protection Regulation") and Officially implemented in 2002. This Regulation aims to provide a unified legal basis for EU industrial designs. EU design law has the characteristic of uniformity, that is, it has the same effect in the 27 EU countries. This principle of uniformity does not apply only in the exceptions specified in the Protection Regulation.
There are currently three ways to protect an EU design: 1. The applicant can submit a registration application directly in the target country; 2. The applicant can submit a registration application to the European Union Intellectual Property Office (EUIPO); 3. The applicant can submit an international registration according to the Hague Agreement Apply. This research report focuses on the second method, which is to submit a registration application to the European Union Intellectual Property Office (EUIPO).
