Recently, the State Intellectual Property Office released the "Frequently Asked Questions for the 2022 Patent Agent Qualification Examination" to answer many questions such as application requirements, registration procedures, and examinations. Previously, the State Intellectual Property Office had issued Announcement of the 2022 Patent Agent Qualification Examination (No. 488).
1. Application conditions
1. Question: What are the registration requirements for the Patent Agent Qualification Examination?
Answer: Chinese citizens who meet the following conditions can register to take the patent agent qualification examination:
(1) Have full capacity for civil conduct;
(2) Obtain a nationally recognized college degree or above in science and engineering, and obtain a diploma or degree certificate.
Chinese citizens and residents of Taiwan who are permanent residents of the Hong Kong Special Administrative Region and Macao Special Administrative Region can register to take the exam.
2. Question: How to determine whether the academic certificate is a nationally recognized academic qualification?
Answer: Applicants can go to the China Higher Education Student Information Network (http://www.chsi.com.cn) to inquire and apply for an electronic verification report of "student status/academic qualifications", that is, the "Electronic Registration Form for Academic Qualification Certificates of the Ministry of Education" or "Ministry of Education Student Status Online Verification Report" (free from January 1, 2018) to determine whether your academic certificate is a nationally recognized academic qualification. The staff of the patent management department of the people's government of the province, autonomous region, or municipality directly under the Central Government where the examination center is located (hereinafter referred to as the "examination center bureau") will conduct an online verification of the academic certificates and academic status/electronic verification of academic qualifications submitted by the applicants. 3. Question: Do foreign language, Chinese, law and other majors meet the academic requirements in the registration conditions?
Answer: Majors such as foreign languages, Chinese, and law are not science and engineering majors, and therefore do not meet the academic requirements in the registration conditions.
4. Question: Do economic, education, management and other majors meet the academic requirements in the registration conditions?
Answer: According to the review principles for the establishment of science and engineering majors for undergraduates and above, the candidates' majors belong to the "Undergraduate Major Catalog of General Colleges and Universities (2020 Edition)" and the "List of New Majors Included in the Undergraduate Major Catalog of General Colleges and Universities (2021 Edition)" published by the Ministry of Education. Answer: According to the 2022 exam announcement, one of the conditions for applying is to obtain a nationally recognized college degree or above in science and engineering, and obtain a graduation certificate or degree certificate. 2. Registration Procedure
Answer: The registration time for this year’s patent agent qualification examination is from 8:00 on July 4, 2022 to 17:00 on July 22, 2022. Please pay attention to the registration time to avoid missing the registration time.
Registration is divided into three steps: pre-registration, qualification review, and payment confirmation. Each examination center bureau is responsible for the specific matters of registration.
9. Question: What are the test points for this year’s Patent Agent Qualification Examination? How many test sites can I choose when registering? Can changes be made after the test site is determined?
Answer: The 2022 Patent Agent Qualification Examination will set up test centers in 32 cities in the mainland and the Hong Kong Special Administrative Region. The mainland test centers are Beijing, Tianjin, Shijiazhuang, Taiyuan, Hohhot, Shenyang, Changchun, Harbin, and Shanghai. 10. Question: What are the registration methods for the Patent Agent Qualification Examination?
Answer: All registration is done online. Applicants should log in to the registration system in the special column of "Patent Agent Qualification Examination" on the State Intellectual Property Office website (http://www.cnipa.gov.cn) within the registration period to pre-register online. Late registration will not be accepted.
11. Question: How do applicants register and sign up?
Answer: The online registration of applicants is divided into two steps: registration and enrollment. Applicants should first register with their identity document information and then register. For those who only pay attention to the exam and are not ready to apply for it, they can register at any time, but there is a time limit for registration, which can only be done between 8:00 on July 4, 2022 and 17:00 on July 22, 2022. 12. Question: Do those who have registered online from 2009 to 2021 still need to register?
Answer: Applicants who have registered online from 2009 to 2021 do not need to register again. They only need to log in directly to register. The "Patent Agent Qualification Examination Registration System" will automatically call up the registration form from 2009 to 2021 to fill in and upload. Registration materials, applicants only need to supplement and modify relevant information.
13. Question: Do I need to provide true identity information when registering?
Answer: Applicants must use their true identity information to register. The registered identity information is directly the key information on the exam registration form. This key information cannot be modified during the subsequent registration and verification processes.
14. Question: What materials need to be filled in or uploaded during pre-registration?
Answer: When pre-registering, you need to fill in the relevant information online and upload the required registration materials:
(1) 2022 Patent Agent Qualification Examination Registration Form and Patent Agent Qualification Pre-Application Form.
(2) Scanned copy of your valid identity document: Applicants should upload a scanned copy of their resident ID card or passport of the People’s Republic of China when registering; applicants from Hong Kong, Macao and Taiwan please refer to Question 39 in Section 4 of this Q&A.
(3) A scanned copy of my academic qualification/degree certificate or an electronic copy of the certification certificate from the China Higher Education Student Information Network or the electronic copy of the certification certificate from the China Degree and Graduate Education Information Network. Those who apply with academic degree certificates from higher education institutions in Hong Kong, Macao, Taiwan or abroad must upload a scanned copy of the academic degree certificate from the Ministry of Education’s Study Abroad Service Center.
(4) An electronic copy of a color, blue-background, front-face ID photo taken within the past three months.
(5) If the academic certificate or degree certificate is in a foreign language, it should be accompanied by a Chinese translation issued by a legally binding translation agency. The Chinese translation does not need to be notarized.
(6) Scanned copy of "Letter of Commitment for Patent Agent Qualification Application". Candidates should download the electronic copy of the "Patent Agent Qualification Application Commitment Letter" from the "Patent Agent Qualification Examination Registration System" and upload the scanned copy after signing.
Those who registered in previous years have submitted the "Letter of Commitment for Application for Patent Agent Qualification". When re-registering, they need to download the electronic copy of the "Letter of Commitment for Application for Patent Agent Qualification" again, sign it and upload the scanned copy.
15. Question: When submitting materials, can I upload photos of relevant documents, certificates, certificates and letters of commitment instead of scanned copies?
Answer: No. Applicants should submit a scanned copy of a valid identity document, an academic/degree certificate or an electronic copy of the China Higher Education Student Information Network certification certificate or the China Degree and Graduate Education Information Network certification certificate, and a scanned copy of the "Patent Agent Qualification Application Commitment Letter".
16. Question: What are the requirements for electronic photos when registering?
Answer: The photo submitted when registering in 2022 will be the only photo used for my qualification review, admission ticket, and patent agent qualification certificate. Therefore, the photo is required to be an electronic copy of my color blue background, front-face, bare-headed ID photo in the past three months, and meet the following requirements Require:

17. Question: For those who registered to take the exam in 2020 and 2021, but only passed the legal knowledge or agency practice part, how can they register this year?
Answer: Applicants who only passed the legal knowledge or agency practice part in 2020 and 2021, when registering this year, only need to register for the subjects they failed and pay the corresponding examination fees in accordance with regulations. When registering online, the "Patent Agent Qualification Examination Registration System" will block subjects that have been passed in previous years and automatically select subjects that have not been passed.
18. Question: For applicants who only passed the legal knowledge or agency practice part from 2009 to 2019, will the passed subject scores still be valid this year?
Answer: For applicants who only passed the legal knowledge or agency practice part from 2009 to 2019, the scores of the subjects that have passed are invalid this year, and the applicants need to re-apply. When registering, you can choose to take the legal knowledge part or the agency practice part according to your own circumstances, or you can take the legal knowledge part and the agency practice part at the same time.
The information submitted in previous years will still be retained in the "Patent Agent Qualification Examination Registration System". Unless there are changes that need to be changed or updates as required, the rest of the information does not need to be submitted again.
19. Question: Those who registered at a certain test center in 2020 or 2021 and passed some subjects must register at the same test center this year? Will choosing other test sites affect the acquisition of the patent attorney qualification certificate?
Answer: Applicants can choose any of the 33 test centers to register and take the exam based on their own circumstances. They do not have to register at the test center selected in 2020 or 2021. As long as the basic information such as name and certificate number remains unchanged, the system will automatically identify and retrieve information from previous years. Choosing other test sites will not affect the acquisition of the patent agent qualification certificate. If the applicant passes the rest of the subjects in this year's exam, he or she will receive a patent agent qualification certificate.
20. Question: What is the relationship between the test center selected during registration and the province (city) where the relevant address in the registration form belongs?
Answer: Applicants can choose any of the 33 test centers to register and take the test based on their own circumstances. The province (city) where the work address and home address in the registration form belong may not be consistent with the test center. In subsequent relevant statistics, the province (city) where the applicant belongs will be based on work address and home address, and the work address will take precedence over the home address in the judgment. Applicants should fill in the relevant address information carefully and truthfully.
21. Question: What should I do if the ID document used when registering this year is different from the ID card used when registering from 2009 to 2021?
Answer: If the applicant used a first-generation ID card when registering from 2009 to 2021, he or she will use the upgraded second-generation ID card when registering this year, that is, only 2 digits of the year and 1 digit will be added to the original 15-digit ID number. If there is a verification code, there is no need to register again, and a valid second-generation ID card should be presented during inspection.
If the certificate type or number used by the applicant when registering from 2009 to 2021 is completely different from the certificate type or number used when registering this year, the "Patent Agent Qualification Examination Registration System" will not be able to identify the valid single subject score of the applicant when calculating scores. , will affect the applicant's acquisition of the qualification certificate. 22. Question: What should I do if my name changes during registration this year?
Answer: Relevant applicants are required to contact the State Intellectual Property Office’s dedicated email address (infosupport@cnipa.gov.cn) in a timely manner to change their name. When making changes, the relevant change certificate issued by the public security department should be submitted.
23. Question: If a registered applicant has forgotten his registration password, how can he retrieve it?
Answer: The registrant first clicks the "Password Retrieval" button on the user login page, and can retrieve the password through email or mobile phone. 24. Question: What should I do if my identity document is lost or invalid during registration?
Answer: Applicants should submit their valid identity documents at the time of registration for registration. After the pre-registration is successful, the qualifications of the applicants will be reviewed online by the test center bureau. The qualification review period is from July 4 to July 29, 2022. 27. Question: How to pay the registration fee when registering? What is considered a successful registration?

The deadline for online payment is 15:00 on August 5, 2022.
Applicants will only be confirmed to have completed the registration process after paying the examination registration fee in full and on time. If the registration fee is late or not paid in full, the registration will be deemed incomplete. Once paid, the registration fee is non-refundable.
28. Question: How to get the admission ticket this year?
Answer: Applicants should log in to the "Patent Agent Qualification Examination Registration System" from 8:00 on October 31, 2022 to 13:00 on November 6, 2022, and print the admission ticket by themselves. The admission ticket contains the personal information of the applicant and the examination time, subjects, location and other contents.
3. Examination
29. Question: When will the patent agent qualification examination be held this year?
Answer: This year’s patent agent qualification examination is scheduled to be held from November 5 to 6, 2022.
30. Question: What subjects are included in the patent agent qualification examination? How is the specific examination time arranged?
Answer: The exam is divided into three subjects. The names of each subject and the exam time schedule are as follows:
Patent legal knowledge: November 5, 9:00-11:30, the question type is multiple choice, with a full score of 150 points;
Relevant legal knowledge: November 5, 14:00-16:00, the question type is multiple choice, with a full score of 100 points;
Patent Agency Practice: November 6, 9:00-13:00, the question type is essay answering and actual writing, with a full score of 150 points.
31. Question: What examination method will be used this year?
Answer: The exam is conducted in a closed-book format. The 2022 Patent Agent Qualification Examination will all adopt a computerized examination method. The computerized examination method refers to the method in which candidates obtain test questions on patent legal knowledge, relevant legal knowledge and patent agency practice subjects on a computer terminal, answer all subjects on the computer terminal and submit the answer results.

34. Question: How can I take the exam if my ID is lost or invalid?
Answer: Applicants should take the exam with their original valid ID at the time. If the identity document is lost or invalid after registration and before the exam, the applicant should go to the local public security bureau in time to apply for a new identity document and take the exam with the original of the new identity document. If there is no time to apply for a new identity card before the exam, a temporary identity card should be obtained. On the day of the exam, take the exam with your valid temporary ID card.

36. Question: How to determine the passing score?
Answer: The Patent Agent Qualification Examination uses the sum of patent legal knowledge and relevant legal knowledge (called the "Legal Knowledge" part) to determine a score line, and the patent agency practice (called the "Agency Practice" part) to determine a separate score line. 37. Question: How to record the passing scores of the Patent Agent Qualification Examination? How is the validity period calculated?
Answer: If the examinee’s test scores in the legal knowledge part or the agency practice part pass the passing score for that part that year, the record of passing the test will be valid for three years from that year. Candidates are required to retake and pass another part of the exam within the next two years.
If a candidate fails to pass both parts of the exam within three years and takes the exam again, the passing score recording period will be restarted.

4. Registration and examination for personnel from Hong Kong, Macao and Taiwan regions
Answer: Chinese citizens who are permanent residents of the Hong Kong Special Administrative Region and Macao Special Administrative Region who meet the registration requirements can register to take the exam, and Taiwanese residents with Taiwan area resident status who meet the registration requirements can register to take the exam. Answer: The test questions are in simplified Chinese characters. Candidates from Hong Kong, Macao and Taiwan can use traditional Chinese characters to answer. 5. Grant of Patent Agent Qualification
43. Question: How to apply for patent attorney qualification after passing the exam?
Answer: When registering for this year’s Patent Agent Qualification Examination, applicants have filled out the Patent Agent Qualification Examination Registration Form and Patent Agent Qualification Grant Pre-Application Form. After the passing scores are announced, candidates who pass all examination subjects within the specified time (hereinafter referred to as The qualification application for qualified personnel) is officially effective and there is no need to apply again.
44. Question: How to conduct qualification verification?
Answer: This year, on-site inspection is not required for the award of patent agent qualifications. The State Intellectual Property Office will conduct online verification on the materials submitted by qualified personnel when registering.
