How to apply specifically? What is the process of trademark registration in Taiwan, China?

Trademark applications in Taiwan are based on the "first to file" principle, but in some cases, trademark rights can also be claimed based on "first to use". In Taiwan, the department responsible for trademark registration is the Intellectual Property Bureau of the Ministry of Economic Affairs. Applicants should entrust a trademark agency recognized by the Intellectual Property Bureau of the Ministry of Economic Affairs to handle various Taiwanese trademark registration matters.

The types of trademarks that can be registered in Taiwan include commodity trademarks, service marks, collective trademarks, certification marks and other trademarks. There are 45 categories in the International Classification of Goods and Services for trademark registration, including 34 categories of goods and 11 categories of services. Text, graphics, marks, colors, sounds, three-dimensional shapes or their combinations can all be applied for trademark registration.

Ⅰ. Materials required for trademark registration in Taiwan, China

1. Application for trademark registration;

2. Applicant’s name and address;

3. Apply for goods or services;

4. Trademark pattern;

5. If the applicant is an enterprise, provide a power of attorney stamped with the official seal and signed by the legal person and a copy of the business license;

6. If the applicant is a natural person, provide a copy of the identity certificate;

7. Countries that have mutual recognition of priority rights with Taiwan, China, can claim priority rights and provide priority documents.

8. Letter of authorization stamped by the applicant.

Ⅱ. Taiwan Trademark Registration Process

1. The trademark authority will first designate an examiner to review an application for trademark registration.

2. The examiner will first conduct a procedural review in accordance with the trademark review regulations, that is, review the content of the application and whether the fee documents are complete. If there are any errors or omissions or the documents are incomplete, the applicant will be notified to make corrections within a time limit.

3. After the procedural review is completed, a physical review will be conducted in accordance with the trademark review guidelines to review whether the trademark design has positive requirements (identification) and does not have negative requirements (special provisions prohibiting registration, such as similarity to other people's trademarks, etc.)

4. After review, if the application is deemed legal, an approval letter will be sent to the applicant and announced in the official gazette of the trademark administration authority.

5. From the date of announcement, registration will not be allowed until there is no objection for three months, or after it is determined that the objection is not established.

6. From the time of receiving the trademark registration application, according to the current practice, it will take about 8-10 months to complete the review and approval.

7. After being approved, it will be announced in the Trademark Gazette for three months to see if there is any objection.

8. After three months of announcement without any objection, the trademark will be registered, and the trademark registration certificate will be issued after about one and a half months.

Ⅲ. Taiwan Trademark Certification Period and Validity Period

If the Taiwan trademark registration is successfully issued, it will take 6 to 12 months. The period of notification of correction, application, defense or postponement due to other legitimate reasons will not be included in the calculation.

An announcement will be made one month after payment of the announcement fee (the 1st and 16th of each month are fixed announcement days), and the trademark certificate will be sent out on the announcement day.

The validity period of trademark registration is 10 years. The trademark right period can be extended by application. The exclusive period of each extension is ten years.

Those who apply for extension of registration during the period of trademark rights should apply from six months before the expiration of the period to six months after the expiration; those who apply within six months after the expiration of the period should pay double the registration fee.

The period of extension approved in the preceding paragraph shall be calculated from the day after the expiration of the trademark right period.

4. What you need to pay attention to after successfully registering a trademark in Taiwan, China

1. If a trademark has not been used for three consecutive years, anyone can apply for trademark cancellation;

2. Taiwan implements a policy of first approving registration and then announcing it. During the announcement period, interested parties can file objection applications against trademarks during this period.
