Shaped by insights from across our user feedback channels, the latest Quality Action Plan from the European Patent Office (EPO) introduces a range of targeted actions to sustain excellence throughout the patent granting process (PGP).

Today we published our Quality Action Plan 2025, which reveals the targeted actions and initiatives we will implement to continue delivering high-quality patents that provide the legal certainty our users expect. The new plan builds on last year’s, which was the first to be made public, and provides transparency on our objectives as well as how we will measure their impact.

Holistic approach enhanced by new KPIs on learning from the Boards of Appeal

To deliver on our commitment to excellence, we take a holistic approach to quality, as outlined in our Patent Quality Charter. Regular updates on the progress that we make towards this year’s key performance indicators (KPIs) throughout the PGP will be provided on our Quality dashboard. This month, five new KPIs have been added to measure the progress we make in learning from Boards of Appeal (BoA) outcomes. The KPIs were developed in light of the comprehensive analysis of BoA decisions we completed in 2024. The analysis showed a high level of alignment between first instance and BoA outcomes, and the new KPIs will help monitor the areas where scope for improvement was identified.

Building further on the achievements 2024

All the priorities for 2025 are designed to build on the achievements of 2024 and the user insights we received during numerous meetings with applicants of all sizes, the activities of the Standing Advisory Committee before the EPO (SACEPO) and its various working groups, the Stakeholder Quality Assurance Panels (SQAPs) and several in-depth workshops. Deepening user dialogue therefore remains a priority, along with investing in our talents and enhancing our tools continuously, including through the use of AI to support improved accuracy and efficiency as volumes of prior art increase. In terms of quality improvements and practice harmonisation, a positive impact can already be seen and thanks to the Active Search Division, early interaction within divisions has increased. The number of quality audit findings related to invalid objections in the search report and written opinion decreased, as did incorrect assessment of novelty and inventive step at grant.

New priorities for 2025

Several further targeted actions draw on the granular analysis we undertook last year. While all priorities for 2025 are documented in the Quality Action Plan, here are some key highlights:

  • To keep examiners up to date with the latest developments in their area of technology we will arrange technology community forums – bringing together leading researchers to present and discuss with our examiners.
  • We will continue to leverage the latest AI technologies to support examiners in the correct and consistent application of the European Patent Convention (EPC) and Guidelines.
  • Active Search Divisions will remain the foundation of our efforts to improve the completeness and accuracy of searches and written opinions.
  • To further harmonise our work practices and safeguard the consistent application of European patent law, we will focus on:
  • consistently assessing inventive step, clarity and the scope of claims
  • substantiating the objections we raise
  • making Unified Patent Court case law more accessible to examiners
  • improving consistency in the handling of third-party observations.
  • We will focus on continuously enhancing the online user services offered in MyEPO.

Deepening user dialogue in 2025

Meeting with applicants and user associations will continue to be a key priority, as will expanding our SME and micro entities outreach programme. The full range of feedback channels remain available to all our users:
