Notice on Reminding Relevant Agencies, Enterprises and Individuals to Apply for Refunds

To protect the legitimate rights and interests of payers, our Office has issued multiple notices to remind relevant parties to apply for refunds. We plan to launch another centralized refund campaign. The notice is as follows:
In accordance with the Guidelines on Trademark Business Payment, where agencies, enterprises or individuals receive payment notices and complete trademark business payments as required, eligible refunds shall be returned to the original payment account. Where a refund fails due to special circumstances such as freezing or loss-reporting of the original payment account, the relevant party may apply for a refund.
Application Method: Log in to the Trademark Online Application System via China Trademark Website → Trademark Payment → Online Services. For trademark services marked “refund failed” under My Account - Payment Status Inquiry, submit a refund application on My Account - Refund Application Page. Fill in refund account information as required and upload supporting documents. Our Office will process the refund upon verification.
Before 30 December 2019, agencies or trademark applicants could remit fees to the Trademark Office account by bank transfer before or upon filing trademark applications. Parties who remitted funds but did not file the corresponding application (or whose application was not accepted), resulting in unused remitted funds, may apply for refunds.
Application Method: Log in to the Trademark Online Application System via China Trademark Website → Trademark Payment → Online Services. Agency users shall apply for refunds on the My Account - Advance Payment Clearing Page. Trademark applicants and agencies eligible for refunds that cease agency business shall register an account in the unified identity authentication system of the National Intellectual Property Administration Public Service Platform, log into the Trademark Online Application System, and submit applications on the My Account - Refund Application Page. Fill in refund account information as required and upload supporting documents. Our Office will process the refund upon verification.
Documents submitted by agencies and enterprises shall bear the official seal of the entity; documents submitted by individuals shall bear the applicant’s signature.
For offline applications, complete the Refund Application Form (Annex 3), prepare documents as specified above, and submit the application to our Office by post or email.
