Several regulations on the implementation of intellectual property, brand, and standardization strategies in Longhua District, Shenzhen City

Chapter 1 General Provisions

Article 1 is to implement the "Implementation Plan on Implementing the Outline Development Plan for the Guangdong-Hong Kong-Macao Greater Bay Area" (Shenzhen Committee of the Greater Bay Area [2019] No. 6) and "Shenzhen's Action to Build a Pioneer Demonstration Zone of Socialism with Chinese Characteristics" Plan (2019-2025)" (Shenfa [2019] No. 13), "Implementation Plan on Carrying out Quality Standard Improvement to Promote High-Quality Development (2019-2022)" (Shenfa [2019] No. 11) and other documents In order to deepen the supply-side structural reform, better adapt to and lead the new economic normal, effectively promote scientific and technological innovation, and enhance the competitiveness of enterprises in Longhua District, these regulations are specially formulated.

Article 2 The use and management of funding funds shall adhere to the principles of “openness, fairness, and impartiality” and implement the management model of “voluntary declaration, expert review, and public disclosure”.

Chapter 2 Funding Conditions

Article 3 Those who meet one of the following conditions may apply for special funding for intellectual property, brand, and standardization strategies:

(1) Enterprises with independent legal personality registered in Longhua District (except guarantee institutions applying for guarantee risk compensation), public institutions and other organizations;

(2) Individuals who have household registration in Longhua District or have lived in Longhua District for one year.

In addition to meeting the above conditions, applicants should also meet other conditions or requirements stipulated in these regulations.

Article 4 Anyone under any of the following circumstances shall not apply for special funding:

(1) The intellectual property rights in the applied project are controversial;

(2) The reporting unit is being jointly punished for breach of trust by relevant departments in accordance with the law;

(3) The applicant has committed fraud in declaring financial funds, or has committed serious breach of contract in receiving financial assistance from governments at all levels;

(4) Other circumstances under which financial assistance is not allowed according to laws, regulations and relevant management documents of municipal and district financial special funds.

Chapter 3 Contents of Special Funding for Intellectual Property

Article 5 Encourage units and individuals to apply for foreign invention patents. Each patent can be funded by up to 2 countries or regions, and the total annual funding for the same applicant shall not exceed 1 million yuan:

(1) If an invention patent is authorized in the United States, the European Union or Japan, a subsidy of 25,000 yuan will be provided for each item;

(2) If an invention patent is authorized in other countries or regions with patent approval agencies, a subsidy of 15,000 yuan will be provided for each application.

Article 6 Copyright demonstration units (park bases) are encouraged to improve their independent innovation capabilities and give full play to their exemplary role in promoting the development of copyright-related industries. The "National Copyright Demonstration Unit" and "National Copyright Demonstration Park (Base)" assessed and licensed by the National Copyright Administration each receive a subsidy of 1 million yuan; the "Guangdong Province Copyright Industry Demonstration Base" assessed and licensed by the Guangdong Provincial Copyright Administration , each family will receive a subsidy of 500,000 yuan.

Article 7 Enterprises are encouraged to increase efforts in cultivating and protecting intellectual property rights. Those identified as "Longhua District Intellectual Property Advantage Enterprises" by the Longhua Supervision Bureau of the Shenzhen Municipal Administration for Market Regulation will receive a subsidy of 500,000 yuan, and no more than 10 will be identified each year; those identified as "Longhua District Small and Micro Intellectual Property Advantage Enterprises" , each company will receive a subsidy of 300,000 yuan, and no more than 10 companies will be identified each year.

Article 8 Enterprises are encouraged to participate in national standards certification for intellectual property rights. Enterprises certified by the national standard implementation certification agency and with more than 10 valid invention patents will receive a subsidy of 300,000 yuan for each enterprise.

Article 9 To implement the supporting funding for patent awards, those who have won the following patent awards can be funded separately, and the first-order patentee should apply for the matching funding. The funding standards are as follows:

(1) Those who win the "China Patent Gold Award" will receive a matching subsidy of RMB 1 million per item; those who win the "China Patent Silver Award" will receive a matching subsidy of RMB 250,000 per item; those who win the "China Patent Excellence Award" will receive a matching subsidy of RMB 10 per item. Ten thousand yuan;

(2) Those who win the "Guangdong Patent Gold Award" will receive a supporting subsidy of 500,000 yuan for each item; those who win the "Guangdong Patent Silver Award" will receive a supporting subsidy of 100,000 yuan for each item; those who win the "Guangdong Patent Excellence Award" will receive a supporting subsidy of 500,000 yuan for each item. Ten thousand yuan;

(3) Those who win the "Shenzhen Patent Award" will receive a supporting subsidy of 150,000 yuan for each project.

Article 10 To support the development of the intellectual property service industry, those who are approved by Shenzhen City to introduce foreign high-end intellectual property service institutions to settle in Longhua District will receive a matching subsidy of 1 million yuan; those who are approved by Shenzhen City to introduce branches of foreign high-end intellectual property service institutions to settle in Longhua District, Each company will receive a matching subsidy of 500,000 yuan; if Shenzhen City introduces domestic high-end intellectual property service institutions to settle in Longhua District, each company will receive a matching subsidy of 500,000 yuan; if Shenzhen City introduces branches of domestic high-end intellectual property service institutions to settle in Longhua District, each company will receive a matching subsidy of 500,000 yuan. A matching subsidy of 250,000 yuan; for institutions or their branches that have won the title of "National Intellectual Property Service Brand Cultivation Institution (National Intellectual Property Service Brand Institution Cultivation Unit)", each institution or its branch will receive a matching subsidy of 500,000 yuan; established with the approval of the State Intellectual Property Office Agencies or their branches that handle more than 100 patent cases within one year from the date of patent agency qualification approval will receive a subsidy of 100,000 yuan each.

Article 11 Enterprises with independent legal person status and mainly engaged in the development, production and operation of high-tech products can apply for a pledge of intellectual property rights (limited to invention patents, utility model patents, design patents, software copyrights, and trademarks) with a period of one year. of bank loans. After the enterprise has paid off the principal and interest of the loan, it can apply for funding based on 70% of the loan interest and intermediary fees (guarantee fees, evaluation fees). The total annual funding for each enterprise shall not exceed 1.2 million yuan.

Article 12 For those who carry out domestic and foreign intellectual property rights protection and win the final effective judgment, 70% of the actual expenses for each case will be funded, and the total annual funding for each applicant shall not exceed 500,000 yuan.

Chapter 4 Contents of Special Brand Funding

Article 13 Encourage applications for overseas trademark registration. The total annual funding for the same applicant (including enterprises and groups) shall not exceed 250,000 yuan; if registered in a single country, the number of funding received by the same applicant in the same country or region (excluding Hong Kong, Macau, and Taiwan) shall not exceed 3:

(1) If registration is obtained through the Madrid System, funding will be provided based on the number of designated countries, with 1,000 yuan for each designated country or region, and a maximum of 20 countries or regions per case; after obtaining the Madrid International Registration Certificate, apply for it in one go with the certificate Funding, no repeated funding will be provided after approval and registration by each designated country;

(2) For those registered in the European Union and the African Intellectual Property Organization, a subsidy of 5,000 yuan will be provided for each case;

(3) If registered in a single country, a subsidy of 2,500 yuan will be provided for each case;

(4) For those registered in Hong Kong, Macau, and Taiwan, a subsidy of 1,500 yuan will be provided for each case.

Chapter 5 Standardization Strategy Special Funding Content

Article 14 Units are encouraged to actively undertake the work of international and domestic standardization professional technical committees. Funding will be provided to relevant units according to the following standards:

(1) For the units responsible for the secretariat of the International Standardization Technical Committee (TC) and its sub-technical committee (SC) secretariat and working group (WG), each unit will be funded with 200,000 yuan, 150,000 yuan, and 50,000 yuan respectively. Yuan;

(2) For the units responsible for the secretariat of the National Standardization Technical Committee (TC) and its sub-technical committee (SC) secretariat and working group (WG), each unit will be funded with 100,000 yuan, 50,000 yuan, and 25,000 yuan respectively. Yuan;

(3) For units that undertake the work of the Secretariat of the Shenzhen Standardization Technical Committee (TC), each unit will be given a subsidy of 50,000 yuan;

(4) For the units that serve as members of the Secretariat of the International Standardization Technical Committee (TC) and its Sub-Technical Committee (SC) Secretariat and Working Group (WG), each member will be funded with 20,000 yuan, 15,000 yuan, and 5,000 yuan respectively. Yuan; for the units that serve as members of the Secretariat of the National Standardization Technical Committee (TC) and its Sub-Technical Committee (SC) Secretariat and Working Group (WG), subsidies of 10,000 Yuan, 5,000 Yuan, and 2,500 Yuan will be provided to each member respectively. Except for units that have received funding from items (1) and (2) above.

For units that undertake the work of multiple above-mentioned committees at the same time, funding will be provided based on the number of projects.

Article 15: Units are encouraged to actively participate in or lead the formulation of standards. Completed standard development projects will be funded according to the following standards:

(1) International standards

Those who take the lead in the formulation of international standards will be given a subsidy of 250,000 yuan per project; those who take the lead in the revision of international standards will be given a subsidy of 100,000 yuan on a project basis.

(2) National standards

Those who take the lead in the formulation of national standards will be given a subsidy of 150,000 yuan per project; those who take the lead in the revision of national standards will be given a subsidy of 50,000 yuan on a project basis.

(3) Industry standards

Those who lead the formulation of industry standards will be provided with a subsidy of 75,000 yuan per project; those who lead the revision of industry standards will be provided with a subsidy of 25,000 yuan on a project basis.

(4) Local standards of Guangdong Province

Those who lead the formulation of local standards in Guangdong Province will be given a subsidy of 75,000 yuan per project; those who lead the revision of local standards in Guangdong Province will be given a subsidy of 25,000 yuan on a project basis.

(5) Shenzhen technical standards (including Shenzhen Special Economic Zone technical specifications, Shenzhen standardization guiding technical documents and Shenzhen agricultural local standards, etc.)

Those who lead the Shenzhen Special Economic Zone Technical Specifications, Shenzhen Municipal Standardization Guiding Technical Documents, and Shenzhen Municipal Agricultural Local Standards will be granted funding of 50,000 yuan, 30,000 yuan, and 20,000 yuan respectively according to the project; those who lead the Shenzhen Special Economic Zone Technical Specifications, Shenzhen Municipal Agricultural Local Standards For standardization guidance technical documents and Shenzhen agricultural local standards revision, subsidies of 25,000 yuan, 15,000 yuan, and 10,000 yuan will be provided respectively according to the project.

(6) Shenzhen Group Standards

Lead the formulation of group standards in Shenzhen. The group standards are issued by social groups or industry alliances, have been effectively implemented for more than one year, and have been self-declared and made public on the Shenzhen Standards Information Platform, and have been adopted by more than 2 companies and self-declared and made public, and have been approved by experts After passing the review, a subsidy of 50,000 yuan will be provided according to the project. The total amount of Shenzhen group standard subsidy received by each social group or industry alliance each year shall not exceed 300,000 yuan. A series of standards formulated by social groups or industry alliances are in principle regarded as one standard.

(7) Enterprise product standards

Each enterprise product standard transformed from a patent will be given a subsidy of 5,000 yuan, and the total subsidy for a single enterprise shall not exceed 50,000 yuan.

For those who participate in the formulation and revision of standards, 50% of the funding amount for the above-mentioned leading formulation and revision will be funded. If multiple units participate in the formulation and revision of the same project, and multiple units meet the funding conditions and apply, the funding funds will be allocated through negotiation between the reporting units, and funding will be provided after reaching an agreement. The only drafting unit of a standard or the top two drafting units in the "Preface" of the standard text are the units that lead the formulation and revision of the standard, and the remaining units are deemed to participate in the formulation and revision.

For the completed various standard development projects mentioned above, the total annual funding from the same unit shall not exceed 1 million yuan.

Article 16 Encourage units and individuals to host the annual meetings and academic seminars of the International Organization for Standardization and major international standardization academic activities in Longhua District. With the approval of the district standardization administrative department, funding will be provided in equal amounts based on the actual expenditure (including material fees, conference fees, expert consultation fees, publicity and promotion fees and other expenses necessary for this project, detailed categories must be listed), and each funding The amount shall not exceed 500,000 yuan.

If the same unit or individual undertakes multiple academic activities in the same year, after approval by the district standardization administrative department, the first item will be funded according to the preceding paragraph, and the second item will be funded at the standard of 50% of the actual cost, and the total annual funding No more than 1 million yuan.

Article 17 Enterprises are encouraged to actively adopt international standards and advanced foreign standards. For enterprises that have obtained the "Guangdong Province Adoption of International Standard Product Approval Certificate", each certificate will be funded with a subsidy of 5,000 yuan, and the total funding for each enterprise shall not exceed 50,000 yuan.

Article 18 In order to set benchmarks and encourage excellence, subsidies will be provided to quality demonstration enterprises (which have introduced excellent performance models and achieved remarkable results). No more than 10 companies receive funding each year, with each company receiving a grant of 300,000 yuan. Award-winning units with full financial allocation will only be awarded honors and no bonuses will be awarded. There is no duplicate application for this project and the Longhua District Quality Award project. During the review period of the Longhua District Quality Award, this project will have a bye.

Chapter 6 Supplementary Provisions

Article 19 The term “above” mentioned in these regulations includes the original number.

Article 20 The same project shall be subject to these regulations, as well as other existing support policies related to intellectual property, brand, and standardization strategies in Longhua District. The same project shall be implemented at a high level and no duplicate support shall be given.

Article 21 The Longhua Supervision Bureau of Shenzhen Municipal Administration for Market Regulation is responsible for the interpretation of these regulations.

Article 22 These regulations will come into effect on August 5, 2020, and will be valid for five years. These regulations will apply to certificates (awards) obtained from January 1, 2018. This regulation applies to projects that have been applied for but have not been reviewed or allocated before the implementation of these regulations. After the implementation of this regulation, "Several Measures for the Implementation of Intellectual Property, Brand, and Standardization Strategies in Longhua New District (Revised in 2015)" (Shenlong Huaban [2015] No. 38) will be automatically abolished.
