Reporters learned from the State Council Information Office press conference on April 24 that the State Intellectual Property Office has launched pilot data protection intellectual property rights in Zhejiang, Shanghai, Shenzhen and other places, striving to achieve replicable and popularizable results in legislation, certificate registration, etc. The experience and practices provide a practical basis for subsequent system design. Among them, Zhejiang has established a public certification platform for data intellectual property and has begun to provide certification services to market entities.

Among them, Zhejiang has established a public certification platform for data intellectual property and has begun to provide certification services to market entities.
Shen Changyu, director of the State Intellectual Property Office, said that data is called the new energy of the information age, and is the foundation for the development of the digital economy alongside traditional elements such as land, capital, and technology. Our country is a country with big data resources and digital economy. In 2020, the added value of the digital economy supported by data has reached 39.2 trillion yuan, accounting for 38.6% of GDP, ranking second in the world. But in order for these data resources to flow reasonably, be fully utilized, and effectively protected, it is necessary to solve the problem of data property rights and improve the design of relevant systems. The "Outline for Building a Powerful Nation on Intellectual Property (2021-2035)" and the "14th Five-Year Plan for National Intellectual Property Protection and Utilization Plan" both make arrangements for the establishment of data property rights protection rules, require the implementation of data intellectual property rights protection projects, and in-depth development of relevant theories and practical research.
Shen Changyu said that the State Intellectual Property Office attaches great importance to this and, in accordance with the relevant arrangements of the central government, is accelerating the promotion of relevant research work in combination with departmental functions and work practices, and has set up a special work class to conduct discussions with relevant departments, experts, scholars, market entities, etc. An extensive and in-depth discussion was held, and some preliminary results and principled ideas were formed. First, we must adhere to security first and development as the most important, and fully consider the security of data, the protection of public interests and the protection of personal information. The second is to fully grasp the unique attributes of data and the development laws of the property rights system, achieve a high degree of consistency between the data protection model and the characteristics of data resources, and organically unify data property rights protection and effective use of data. The third is to fully respect the creative labor and capital investment of data processors, and recognize and protect the reasonable benefits of data processors. Fourth, it must be conducive to the flow and transaction of data, promote the prosperity of the data market, strengthen the digital industry, promote the digital transformation of industries, and support high-quality economic development.
It is reported that in the next step, the Intellectual Property Office will continue to strengthen cooperation with all parties, increase theoretical research and practical exploration, and accelerate the establishment and improvement of my country's data property rights protection system.
