Notice from the Shenzhen Municipal Administration for Market Regulation on Carrying out the Review of the Application and Recommendation of National Intellectual Property Advantage Demonstration Enterprises in 2022

Relevant enterprises: In order to strengthen the cultivation of national intellectual property demonstration enterprises and advantageous enterprises in our city, according to the "Notice of the Office of the State Intellectual Property Office on Carrying out Demonstration Work for Enterprises in Building a Strong Intellectual Property Power in 2022" (Letter from the State Intellectual Property Office [2022] 〕No. 497) (hereinafter referred to as the "Notice") requires that our office is now carrying out the application, recommendation and review of national advantage demonstration enterprises in 2022. The relevant matters are now notified as follows: 1. Scope of conditions (1) Application and recommendation of national advantage demonstration enterprises Conditions: Encourage and support enterprises in our city to actively participate in the declaration of national intellectual property advantages enterprises. In order to strengthen the cultivation of national intellectual property demonstration enterprises and advantageous enterprises in our city, according to the "Notice of the Office of the State Intellectual Property Office on Carrying out Demonstration Work for Enterprises in Building an Intellectual Property Power in 2022" (State Intellectual Property Office Hanyun Zi [2022] No. 497) (hereinafter referred to as the "Notice") requires that our Bureau is now carrying out the application, recommendation and review of national advantage demonstration enterprises in 2022. The relevant matters are now notified as follows:

1. Scope of conditions

(1) Recommended application conditions for enterprises with national intellectual property advantages:

Encourage and support enterprises in our city to actively participate in the declaration of national intellectual property advantages enterprises. Applicants must meet the following conditions:

1. Register in the Shenzhen Administrative Region;

2. It has certain influence in the region and outstanding intellectual property advantages;

Those that have been identified as national intellectual property advantage and demonstration enterprises shall not apply again.

(2) Application conditions for national intellectual property demonstration enterprises:

National intellectual property advantageous enterprises that have been cultivated for three years (including advantageous enterprises recognized in 2019 and before).

(3) Scope of review. National intellectual property advantage enterprises and demonstration enterprises recognized in 2019 and before are required to participate in the review.

2. Application and review procedures

This year’s application and recommendation of national intellectual property advantageous enterprises and the review of national intellectual property demonstration enterprises are carried out through the national intellectual property advantageous enterprises and demonstration enterprise management system (website: https://declare.cneip.org.cn). The specific process is as follows:

(1) Enterprise registration in the management system: Declaring and reviewing enterprises should complete the online registration information before 24:00 on June 15.

(2) Registration information review: Our bureau conducts a preliminary review of the authenticity, completeness, and compliance of enterprise registration information. Enterprises that pass the preliminary review can obtain the online assessment QR code and key through the management system.

(3) Enterprise online assessment: Enterprises scan the assessment QR code with their mobile phones, log in to the State Intellectual Property Office assessment system "International Standard Assessment of Innovation Management and Intellectual Property (ISO56005/56002) Assessment System (1.0)" applet, and enter the key. Complete the assessment online (both on mobile and PC). Enterprises can only fill in the report once with the evaluation anonymous code and key. Once the relevant information is submitted, it cannot be modified. Enterprises are required to prepare the data in advance according to the "International Standard Assessment of Innovation Management and Intellectual Property Rights (ISO56005/56002) Assessment System (1.0)" electronic document before filling it in online. Please review it carefully after filling it out. Wait until the data is filled in correctly before submitting. The evaluation system will be closed at 24:00 on June 30, and companies should complete the online evaluation before that.

Enterprises are requested to fill in the evaluation questionnaire truthfully in the evaluation system. The State Intellectual Property Office will verify the authenticity of the relevant information through various methods. If there is any fraud, once discovered, the corresponding qualifications will be immediately revoked.

(4) Publication of evaluation results: The national bureau will collect statistics on the evaluation results and publish the qualifying lines for advantageous enterprises and the qualifying lines for demonstration enterprises;

(5) Submission of materials: Enterprises that apply for national intellectual property demonstration enterprises and pass the demonstration enterprise qualification line shall upload relevant texts and supporting materials in accordance with the "Evaluation Key Points" of the State Intellectual Property Office (to be announced). The specific time will be notified separately by our office. There is no need to upload text and supporting materials for enterprises that declare advantages and review advantages (demonstration).

3. Recommendation and review procedures

(1) Application recommendation

Our office will review the applications and demonstration enterprises that have passed the evaluation, comprehensively evaluate and review the results, and recommend the best to the State Intellectual Property Office according to the quota.

(2) Review and report

Our office will conduct a preliminary review of the reviewed companies that have passed the assessment, initially determine the list of advantageous companies and demonstration companies that have passed the review, and submit it to the State Intellectual Property Office for review.

4. Review and Identification

The State Intellectual Property Office will review and confirm the review status and recommendation list of applying enterprises submitted by our office, as well as the list of enterprises that have been initially determined to pass the review. After it is announced that there is no objection, a document will be issued to confirm it.

Enterprises that fail to pass the review will retain their qualifications and organize another review within a one-year period. Enterprises that have not passed or failed to participate in the review will be withdrawn from the list.

5. Things to note

(1) Each enterprise is required to strictly refer to the information on the notice board of the National Intellectual Property Advantage Enterprise and Demonstration Enterprise Management System and the enterprise filling instructions in the upper right corner of the enterprise port to complete the application. If the system cannot register or fill in the form normally, please contact the technical contact in the company's filling instructions.

(2) Enterprises should complete registration, online assessment and other related work within the designated time. If it is overdue, the relevant systems will be closed.

(3) Advantageous enterprises that apply for demonstration enterprises will be deemed to have participated in the review of advantageous enterprises at the same time, and there is no need to submit a separate review process.
