Implementation Rules of the Shenzhen Municipal Administration for Market Regulation on the Municipal Science and Technology Award Standard Award
Chapter 1 General Provisions
Article 1 In order to standardize the evaluation procedures for the Shenzhen Science and Technology Award Standard Award (hereinafter referred to as the Standard Award) and ensure the quality of the evaluation, according to the "Shenzhen Science and Technology Award Measures" (Shenzhen Regulations [2022] No. 3) (hereinafter referred to as the "Award Measures") The relevant provisions of the present implementation rules are formulated.
Article 2 These implementation rules apply to the nomination, acceptance, review, publicity, awarding and other activities of the Standard Award.
Article 3 The Shenzhen Municipal Market Supervision and Administration Department (hereinafter referred to as the Municipal Market Supervision Department) is responsible for the acceptance and review organization of the Standard Award.
Article 4 The standard awards are reviewed once a year, and the awards are not divided into levels. The total number of awards awarded each year does not exceed 15, and each award is 300,000 yuan.
Article 5 No reward will be given if one of the following circumstances exists:
(1) Failure to meet the relevant requirements of the "Incentive Measures";
(2) Relevant entities are included in the list of national, provincial, or municipal seriously untrustworthy entities in accordance with laws and regulations or are disqualified from being nominated in accordance with the "Rewards Measures";
(3) After checking the People’s Court Announcement Website, it is found that the relevant entity has entered the bankruptcy liquidation procedure;
(4) The same project has won the China Standard Innovation Contribution Award, Guangdong Province, and Shenzhen City Standard Award;
(5) Other situations stipulated by laws and regulations.
Article 6 The municipal market supervision department shall issue a notice on the nomination work of the Standard Award every year, announce the requirements for nomination materials, acceptance time and methods and other relevant matters, and carry out the nomination, acceptance, review and other work of the year.
Chapter 2 Reward Scope and Conditions
Article 7 The project scope of the Standard Award refers to the following standards that are currently valid and have been implemented for more than 2 years (including 2 years) and within 4 years: national standards, industry standards (which need to be registered with the National Standardization Administration Committee), local standards, and have been implemented in the country or within 4 years. The Shenzhen Group Standards Information Platform carries out self-declaration and disclosure of group standards, which are drafted and formulated by Chinese experts and jointly implemented by the International Organization for Standardization (ISO), the International Electrotechnical Commission (IEC), the International Telecommunications Union (ITU), and the "Adoption of International Standards Management Measures" Confirmed international standards issued by other international organizations and international advanced standards issued by other important organizations.
Article 8 Projects nominated for the Standard Award shall comply with the provisions of the "Award Measures" and meet the following conditions:
(1) The standard is highly innovative and plays a prominent role in promoting the development of this field;
(2) The standard technology is advanced and contains advanced research results or independent intellectual property rights;
(3) The standard has been implemented and achieved significant economic, social or ecological environmental benefits.
Article 9 The Standard Award is awarded to individuals and organizations that have made significant contributions in standardization activities (hereinafter collectively referred to as nominees).
Article 10 The nominated organization must be an enterprise, institution, social organization or other organization engaged in production, operation, scientific research and other activities in Shenzhen, and be the leading completion unit of the standard project.
Article 11 The method for determining the leading completion unit of standard projects is as follows:
(1) The leading completion unit of national standards, industry standards, and Shenzhen local standards is the first drafting unit indicated in the "Preface" of the standard, and group standards are the issuing unit of the standard. If the drafting unit is not indicated in the "Foreword", the technical committee corresponding to the standard shall issue the materials leading the formulation of the standard.
(2) The leading completion unit of the international standard is the unit that plays a key role in the formulation of the standard and whose proposal is the core content of the standard. The supporting materials include:
1. Minutes of the standard project establishment meeting, specifying the leading unit or person in charge, convener, etc. of the project establishment;
2. Main participants in the preparation of standards, time of attendance at the meeting, photos of participants, air tickets, meeting sign-in form, list of meeting expert groups, proposal materials submitted at the meeting, etc.;
3. The personnel participating in the preparation are full-time employees of the nominated unit, including labor contracts, social security payment details for more than one year, etc.;
4. Technical proposals submitted by writers during the standard project discussion, approval, and release processes, the final adopted voting results, meeting minutes, and the standard text content corresponding to the proposal, etc.;
5. Other necessary supporting materials.
Chapter 3 Nomination
Article 12 The Standard Award implements a nomination first and then review system. Candidate projects are nominated by the following units or individuals (hereinafter collectively referred to as nominators):
(1) Relevant departments of the Municipal People’s Government and the science and technology departments of each district government (Dapeng New District, Shenshan Special Cooperation Zone Management Committee);
(2) Academicians of the Chinese Academy of Sciences and the Chinese Academy of Engineering working in Shenzhen;
(3) Shenzhen universities and scientific research institutions, as well as Shenzhen municipal comprehensive, professional and standardized non-profit legal person organizations that voluntarily cooperate in the nomination work;
(4) Experts who are included in the management of Shenzhen Standard Expert Database and are within the employment period;
(5) Other units or individuals that meet the provisions of Article 18 of the "Rewards Measures".
Article 13 Nominators should nominate within the scope of their own discipline, industry, and department. If the nominator is an organization, they can nominate three projects per year. If the nominator is an individual, they can nominate one project per year.
Article 14 When nominating a candidate project for the Standard Award, the nominator shall make an objective evaluation of the project according to the nomination scope and conditions of the Standard Award, fill in the nomination form, and provide necessary certification or evaluation materials, etc. The nominator shall be responsible for the authenticity of the nomination letter and related materials, and shall bear corresponding obligations in nomination, defense, objection handling, etc. The main completer and completion unit of the nominated standard project shall be consistent with the main drafter and drafting unit listed in the standard text or relevant certification materials.
Article 15 The nominator cannot be the person who completed the nominated project in the same year, and cannot be from the same unit as the person who completed the nominated project, and should avoid relevant review activities.
Article 16 Nomination materials submitted for the Standard Award include:
(1) Nomination letter for Shenzhen Science and Technology Award Standard Award;
(2) Relevant subject qualification documents of the nominee;
(3) Standard texts such as international standards, national standards, industry standards, Shenzhen local standards, group standards, etc. that have been published and implemented;
(4) Except for group standard projects, the document approved by the statutory competent authority for the issuance of the standard;
(5) Supporting materials for the technical level of standard projects such as expert review opinions and project appraisal conclusions during the standard review;
(6) Supporting materials for the economic and social benefits or ecological and environmental benefits brought by the standard project;
(7) Relevant supporting materials as stipulated in Article 11 of these Implementing Rules.
Chapter 4 Acceptance
Article 17 The municipal market supervision department shall conduct a formal review of the nomination materials, and require the nomination materials that do not meet the regulations to be supplemented and corrected within a time limit; if the supplements are not made within the time limit, the nomination will be deemed to have been abandoned; if the nomination materials still do not meet the regulations after supplements and corrections, the application will not be accepted.
Article 18 Projects that pass the formal review shall be publicized by the municipal market supervision department, and the publicity period shall be no less than 10 days.
If any organization or individual has any objections to the public announcement items, they must raise them within the time specified in the public announcement. Objections raised after the time limit or without valid reasons will not be accepted.
Organizations or individuals raising objections should indicate their true identity and provide legal and valid written materials and other supporting materials. If a natural person raises an objection, the objection materials should record clear contact information such as mailing address, telephone number, etc., and sign with the real name; if an organization raises an objection, the written materials should be signed and confirmed by its legal representative and stamped with the official seal.
Chapter 5 Review Organization
Article 19 The municipal market supervision department shall formulate an annual review plan and establish an expert review committee (hereinafter referred to as the review committee). The review committee shall be composed of 7 or more standardization experts in odd-numbered related fields.
The jury shall have one chairman. The chairman shall have experience in award review or senior standardization work experience and shall be elected by the members of the jury. The chairman is responsible for presiding over the review meeting and submitting the review results on time.
Article 20 The evaluation committee shall conduct project evaluation according to the evaluation plan. The evaluation is divided into preliminary review and re-examination, and shall be conducted in accordance with the following rules:
(1) Preliminary review:
1. The municipal market supervision and administration department will submit the standard projects that have passed the formal review to the evaluation committee for review.
2. Each expert on the judging panel independently scores the project. The average of the scores of all experts on the judging panel is the judging score for the project.
3. The jury will determine the list of projects shortlisted for review in order from high to low based on the scores of each project. The total number of projects shortlisted for review shall not exceed 18, and the same nominee shall not be shortlisted for more than 2 projects.
(2) Review link:
1. The jury will review the shortlisted review projects; the experts of the jury will question the shortlisted review projects, and the nominees will respond; the jury can organize experts to conduct on-site verification of the nominees as necessary, and the number of on-site verifications shall be no less than 3.
2. Each expert on the judging panel will independently score the shortlisted review projects based on application materials, inquiries and on-site inspections. The average score of all experts on the judging panel will be the review score for the project.
3. The jury will submit a list of recommended award-winning projects to the municipal market supervision department based on the review scores. The total number of recommended award-winning projects shall not exceed 15, and the total number of recommended alternative projects shall not exceed 3.
Article 21 The review shall implement a recusal system. Review experts and relevant staff who have an interest in the nominee or nominator shall recuse themselves; there shall be no more than one expert from the same unit.
Article 22 If the review expert is unable to perform the review duties normally due to special reasons, the municipal market supervision department shall be notified in a timely manner, and the municipal market supervision department shall select another one from the list of expert databases.
Article 23 The review experts and staff shall keep the review status, the list of experts, and the technical content of the participating projects confidential.
Chapter 6 Awarding
Article 24 For the proposed award projects and candidate projects recommended by the jury, the municipal market supervision department shall, in accordance with the provisions of the "Award Measures", report to the municipal finance, scientific and technological innovation, development and reform, industry and information technology, taxation, Shenzhen Customs and other relevant departments. If the department solicits opinions and raises no objection, it will be deemed that it agrees with the proposed award. If the proposed award projects meet the relevant requirements after review, they will be reported to the Municipal Science and Technology Awards Committee Office (hereinafter referred to as the Municipal Awards Office), which will review and announce the awards to the public. The annual standard award projects will be determined after approval by the municipal government.
Article 25 After the standard award winner has prepared the award certificate, payment receipt, bank account and other materials, he will go to the municipal market supervision department to handle the bonus disbursement procedures.
Chapter 7 Supervision and Management
Article 26 If the nominee commits fraud or uses other improper means to defraud the standard award, and if the nominator provides false data and materials to assist others to defraud the standard award, the municipal market supervision department shall report it to the municipal awards office. According to the "Awards" The relevant provisions of the Measures shall be dealt with.
If the relevant staff and review experts who participate in the review of the Standard Award engage in fraud, malpractice for personal gain, or other violations of laws and regulations during the review activities, the staff will be disclosed by the municipal market supervision department in accordance with the relevant provisions of the "Award Measures", and administrative responsibilities will be investigated in accordance with the law; review Experts will be disclosed by the municipal market supervision department in accordance with the relevant provisions of the "Rewards Measures" and reported to the Municipal Rewards Office for processing in accordance with the relevant provisions of the "Rewards Measures".
Chapter 8 Supplementary Provisions
Article 27 The municipal market supervision department is responsible for the interpretation of these implementation rules.
Article 28 These implementation rules will come into effect on November 1, 2022, and will be valid for 5 years. The "Implementation Rules for the Shenzhen Science and Technology Award (Standard Award) Award Measures" (Shenzhen Quality Regulations [2017] No. 7) are abolished at the same time.
