I. Legal basis

According to the provisions of Article 72 of the Trademark Law of the People's Republic of China and Article 18 and Article 97 of the Regulations on the Implementation of the Trademark Law of the People's Republic of China, anyone who applies for trademark registration and handles other trademark matters shall pay fees.

II. Fee items and standards

Charge basis: former State Planning Commission, Ministry of Finance calculation price (1995) No. 2404 document, National Development and Reform Commission, Ministry of Finance development and reform price (2015) No. 2136 document, Ministry of Finance, National Development and Reform Commission Finance and taxation (2017) No. 20 document, National Development and Reform Commission, Ministry of Finance development and reform price (2019) No. 914 document.

III. Payment method

In order to implement the goal of trademark facilitation reform, further simplify the trademark business payment process, and promote the electronic reform of financial bills, all trademark businesses can pay fees and receive bills online, it is recommended that parties and agencies adopt online payment, the specific ways are as follows:

The parties to the trademark application and the agency shall pay the fees to the Trademark Office within 7 days from the date of receipt of the payment notice of the Trademark Office, among which the domestic business issues the Payment Notice and the international business issues the Payment Notice of the International registration of the Trademark.

1. If the applicant entrusts an agency to handle the transaction, it is not necessary to pay the fee by itself, and the entrusted agency shall pay the fee on behalf of the applicant according to regulations.

(1) If the agency has registered an official user on the online application platform, the payment notice submitted has no payment code, and the agency must log in the account of the agency to make online payment in the trademark online application system.

(2) If the agency does not register a formal user on the online application platform, it shall register a simple user on the online application platform and make online payment with the payment code.

2. Directly handled by the applicant:

(1) If the applicant submits the application online, there is no payment code in the payment notice, and the applicant must log in to the account where the application is submitted for online payment in the trademark online application system.

(2) The applicant directly in the trademark Office registration hall, Zhongguancun office, Beijing foreign Trademark Examination Association Center, acceptance window to submit the application or through the postal or other Courier companies to submit the application, after receiving the payment notice must log in the registration online application platform user with the payment code online payment fee, not registered online application platform official users, You can register for a simple user fee.

3. Special circumstances. If the applicable payment notice has a payment code, but it is really impossible to complete the payment through the payment code on the online application platform due to special circumstances, the following methods can be used to pay the fee:

(1) The payment notice with the payment code is paid by bank transfer (please transfer the money through the bank account, and the payment cannot be successfully made through the address remittance of the Postal Savings Bank of China).

Special attention: the remitter should only fill in the payment code in the postscript when making the remittance. If the payment information is filled in incorrectly, the relevant information can be added in the function of "Application for Bank Transfer Supplementary Payment Information" on the online application platform of the Trademark Office within three days of the remittance; If it is not possible to supplement the information through the "Application for Supplementary payment Information by bank remittance" function, the copy of the payment notice (stamped with the official seal of the remitter or the signature of the remitter) and the bank remittance receipt shall be mailed to the Trademark Office, and the postmark date of sending the mail shall be regarded as the payment date (if the postmark date is not clear, the postal certificate shall be provided). Failure to fill in the payment code as required, failure to supplement payment information or mail materials as required, insufficient remittance amount, overdue payment shall be regarded as unpaid, and the submitted application shall not be accepted according to law.

(2) If the party directly submits the document in the Trademark Office registration hall, it can hold the payment notice with the payment code to pay the fee at the Trademark Office registration hall.

① Cash: The applicant can pay in cash at the trademark registration hall.

②pos card swipe method: The applicant can pay the fee at the registration hall of the Trademark Office with the UnionPay card.

③ wechat, Alipay: The applicant can scan the code at the registration hall of the Trademark Office to pay.

④ Check method: Applicants in Beijing and Tianjin can submit bank transfer checks consistent with trademark business applicants to the trademark registration hall for payment.

⑤ Bank draft method: non-Beijing applicants can submit the same bank draft as the trademark business applicant to the trademark Office registration hall payment. After the applicant submits the bank draft, it needs to wait two to three working days in Beijing, and the bank will pay the money before it can be processed.

(3) If the parties directly handle the application and submit the application online in the Foreign Trademark Examination Cooperation Center or the acceptance window, they can hold the payment notice with the payment code to the foreign Trademark Examination Cooperation center or the acceptance window, and pay the fee according to the two-dimensional code in the trademark online service system presented by the trademark Examination Cooperation center or the acceptance window.

IV. Payment time

1. If the party or agency pays the fee through the trademark online service system (official or simple user), the user must log in to pay the fee to the Trademark Office online during the opening hours of the system. The payment time shall be based on the actual payment time received by the trademark online service system from the third-party online payment platform. If no feedback information is received from the third-party payment platform after the opening time of the system, the order shall be deemed as not submitted.

2. The party or agency shall pay the fee to the Trademark Office within 7 days from the date of receipt of the notice of payment from the Trademark Office. If the payment is not made within the time limit, the Trademark Office shall not accept the application.

V. Rules and methods of receipt of bills

1. Enable financial electronic bills. Parties and agencies shall pay trademark fees and issue electronic bills in a unified manner. According to the document of the Ministry of Finance, "Notice of the Ministry of Finance on the Unification of the National Financial Electronic Bill model and the financial machine bill Model" (Fiscal Summary [2018] 72), the financial electronic bill can be entered into the account and reimbursed. After receiving the bills, each unit shall strictly comply with the provisions of the relevant departments to ensure the authenticity and effectiveness of the bills and prevent the bills from being repeatedly entered into the account and reimbursed.

2. If a party applies for a trademark on its own, the electronic bill shall be issued to the party; Where a party entrusts a trademark agency to handle an application for a trademark, the object of the electronic bill shall be the trademark agency.

3. If the parties and agencies pay through the trademark online service system (official users or simple users), they need to use the payment account to log in to the trademark online service system to download the electronic bill on their own within 5-7 working days after payment.

4. If the online application is submitted in the overseas Trademark Examination Cooperation Center and the acceptance window, the download link of the financial electronic bill of the party shall be sent to the E-mail address reserved by the party in the form of an electronic document, which shall be downloaded in time.

5. Other circumstances:

(1) If the agency with the trademark online application user submits the paper application, the financial electronic bill will be directly sent to the online user of the agency; With multiple users, send to the latest and valid online user.

(2) Where the party directly submits the paper application in the Trademark Office registration hall, Zhongguancun Office, Beijing Foreign Trademark Examination Association Center, or the acceptance window, or submits the paper application through postal or other express delivery enterprises, and pays the trademark fee by bank remittance after receiving the payment notice (with the payment code), If E-mail information is added in the function of "Application for Supplementary Payment Information by Bank Remittance", the electronic bill will be delivered to the party by E-mail; If the email address information is not added in the function of "Application for Supplementary payment Information by bank remittance", the printed copy of the financial electronic bill shall be sent to the party by certified mail.

(3) If you pay the fee on the spot in the trademark registration hall, you can receive the printout of the financial electronic bill on the spot.

Special attention: Those who receive the financial electronic bill print should log in to the trademark online service system to download the electronic version of the financial electronic bill print with the information of the financial electronic bill print through the online application platform user 5-7 working days after payment; If you have not registered an official user of the online application platform, you can register a simple user binding download. Among them: Parties who submit paper applications and pay trademark fees by bank remittance in the Foreign Trademark Examination Cooperation Center and the acceptance window, due to special circumstances, are unable to obtain the electronic version of the financial electronic bill print through the online application platform, can go to the Beijing foreign Trademark Examination Cooperation Center or the acceptance window to receive the electronic version of the financial electronic bill print.

6. Trademark online service system electronic bill storage period is 3 months, the parties and agencies should be downloaded in time after payment, beyond the storage period, need to file an application to the trademark Office, log in to the trademark online service system to download.

Vi. Refund matters

1. If the parties and agencies receive the payment notice and handle the trademark business payment in accordance with this Guide, there is no business that needs to be refunded.

2. Parties and agencies may apply for the refund of funds remitted to the bank account of the Trademark Office by bank transfer prior to the publication of this Guide, please refer to the Refund Guide (see annex).

Ⅶ. Receipt of return letters for financial instruments

1. Trademark agency organization to obtain unified ticket please bring the following documents:

(1) A copy of the business license stamped with the official seal of the trademark agency organization.

(2) A valid letter of introduction issued by a trademark agency.

(3) The original and photocopy of the recipient's ID card.

(4) To entrust another person to collect it, a power of attorney shall be submitted at the same time, and the power of attorney shall specify the entrusted matters.

(5) Where the name of the trademark agency organization is changed, the original and photocopy of the certificate of name change issued by the registration authority shall be submitted.

2. Enterprises to obtain unified bills please bring the following documents:

(1) A copy of the business license with the official seal of the enterprise.

(2) A valid letter of introduction issued by the unit.

(3) The original and photocopy of the recipient's ID card.

(4) To entrust another person to collect it, a power of attorney shall be submitted at the same time, and the power of attorney shall specify the entrusted matters.

(5) If the name of the enterprise is changed, the original and photocopy of the certificate of name change issued by the registration authority shall be submitted.

3. Natural person to obtain the unified ticket please bring the following documents:

(1) The original and photocopy of the recipient's ID card.

(2) To entrust others to collect it, a power of attorney shall be submitted at the same time, and the power of attorney shall specify the entrusted matters.
