Notice of the Shenzhen Municipal Supervision Bureau on the unified implementation of the revised operating procedures for special funds in the field of intellectual property starting from 2022

"Comprehensively cancel local subsidies and rewards for the trademark and patent application stages, and promote the transformation of intellectual property work from pursuing quantity to improving quality" and other relevant policy orientations and work requirements, as well as relevant work requirements for the special audit investigation of the Shenzhen Municipal Audit Bureau, regarding trademarks, Funding and awards in the patent application stage will be completely canceled after the last batch of funding awards are allocated in 2021. Together with other general funding awards under the approval system, new operating procedures will be implemented uniformly from 2022.

All relevant units and individuals:

In order to strictly implement the requirements of the State Intellectual Property Office on promoting the transformation of intellectual property work from pursuing quantity to improving quality, optimizing and adjusting the policy orientation of intellectual property funding and rewards, and the relevant special audit investigation work requirements of the Shenzhen Municipal Audit Bureau, our bureau has publicly solicited opinions from the public. and relevant legal procedures, the revised "Operation Regulations for Special Funds in the Field of Intellectual Property of the Shenzhen Municipal Administration for Market Regulation" (Shenzhen Market Supervision Administration [2022] No. 10) (hereinafter referred to as the new operating regulations) was issued on November 4, 2022. In order to implement the revised funding and reward policy, the relevant work arrangements are hereby notified as follows:

1. Comprehensively implement the “Notice of the State Intellectual Property Office on Deepening the Reform of “Delegating Power, Delegating Power, Delegating Power, Delegating Power and Service” in the Field of Intellectual Property to Optimizing the Innovation Environment and Business Environment (Guozhifafuzi [2021] No. 10) on “Comprehensively canceling all local restrictions on trademarks, Funding and rewards at the patent application stage to promote the transformation of intellectual property work from pursuing quantity to improving quality" and other relevant policy orientations and work requirements, as well as relevant work requirements for the special audit investigation of the Shenzhen Municipal Audit Bureau, funding and rewards at the trademark and patent application stage After the last batch of funding awards is disbursed in 2021, such funding and awards will be completely cancelled, along with other approval-based general funding awards, and new operating procedures will be implemented uniformly from 2022. Specifically include:

(1) Article 10 of the "Operating Rules for Special Funds in the Field of Intellectual Property Rights of Shenzhen Municipal Administration for Market Regulation" (Shenzhen Market Supervision and Administration Bureau [2019] No. 10) (hereinafter referred to as the original operating rules) before the revision will be effective from 2022 ( It will no longer be implemented from January 1, 2022 to December 31, 2022 (the same below).

(2) Article 11 of the original operating procedures "Copyright Registration Subsidy" will no longer be implemented starting from 2022.

(3) Article 13 of the original operating procedures "Funding after certification of implementation of intellectual property management standards" will be implemented in accordance with Article 9 of the new operating procedures from 2022.

(4) Article 14 of the original operating procedures "Intellectual Property Project Supporting Rewards" will be implemented in accordance with Article 10 of the new operating procedures from 2022.

(5) Article 21 of the original operating procedures, "Patent Agency Training Project Funding," will be implemented in accordance with Article 26 of the new operating procedures from 2022.

(6) Article 26 of the original operating procedures "Supporting rewards for intellectual property service brand institutions" will no longer be implemented starting from 2022.

2. The operating procedures for special funds in the field of intellectual property will be further optimized and adjusted according to the actual situation in Shenzhen, and the overall support for Shenzhen’s intellectual property undertakings will be basically stable. In the policy adjustment work, our bureau will optimize the use and management of financial funds related to intellectual property funding in accordance with the relevant work requirements of the superior authorities and the municipal party committee and municipal government, and study and introduce high-quality oriented funding and reward policies that meet the new situation and new requirements. Focus on increasing support for the transformation and application of intellectual property rights, administrative protection and public services. We welcome all types of innovation and entrepreneurship entities in our city to provide valuable opinions and suggestions during our bureau’s public solicitation of opinions from the public and special symposiums.
