In the international stage, the applicant will receive an international search report and written comments, which not only contain one or more prior art documents, but also contain important information about the patentability of the invention, so that the applicant can understand the situation of the prior art, and provide a solid foundation for the applicant to decide how to take the next action.
If the applicant applies for the international preliminary examination, the applicant can also get a high standard international preliminary examination report made by the international preliminary examination unit, the international preliminary examination report will initially indicate whether the application is novel, creative and practical, and the applicant can consider whether to enter the national stage based on the results of the report. Because the cost of entering the national stage is generally much higher than the cost of the international stage, if the international preliminary examination report is abandoned to apply for a foreign patent, it can save a lot of costs.
The applicant has the opportunity to amend the international application during the optional international preliminary examination stage, to speak to the examiner to fully defend the application, and to have the application in place before it is processed by the respective national patent offices.
If a State party has a PCT Patent Examination Highway (PCT-PPH) agreement or similar agreement, it is also possible for the applicant to expedite the examination process at its national stage.
