All relevant universities, scientific research institutes, and all relevant units:

The "Patent Law" that came into effect on June 1, 2021 created an open patent licensing system. The"Patent Law Implementing Rules"and related supporting examination rules are currently being revised.In order to ensure the smooth implementation and efficient operation of the patent open licensing system, the State Intellectual Property Office organized a pilot program for patent open licensing, with Guangdong Province as one of the pilot provinces. In order to further support the innovation achievements of innovative entities such as universities and scientific research institutes in the province to benefit more small, medium and micro enterprises in the province and serve the innovation-driven development needs of the province, the Provincial Intellectual Property Office, the Provincial Department of Science and Technology, and the Provincial Department of Education decided to jointly target the province Universities and scientific research institutes have organized pilot projects for patent open licensing in our province and collected a batch of patents for pilot open licensing. The relevant matters are hereby notified as follows:

1. Patent requirements

Patents involving key industries in our province are encouraged to implement open licensing. Patents that implement open licensing should meet the following conditions:

(1) The legal status of the patent is a valid patent, and the patent ownership is clear.

(2) The patent is not under exclusive license or exclusive licensing status.

2. Collection objects and requirements

(1) Universities, scientific research institutes and other units undertaking the 2021-2022 Guangdong Provincial Patent Conversion Special Plan Project shall each collect and publish more than 50 open license patents;

(2) National intellectual property pilot universities and national intellectual property demonstration universities, each collecting and publishing more than 30 open license patents;

(3) Provincial high-level universities, each of which collects and publishes more than 15 open license patents;

(4) Other universities, scientific research institutions and other units shall collect and publish more than one open license patent each.

(5) Other units that are willing to open patent licensing.

3. Collection time

(1) Each unit is requested to sort out the list of patents available for open licensing in its unit in a timely manner, fill in the form (see Attachment 1 and Attachment 2), and submit it to the Provincial Intellectual Property Office before July 10. The WORD version of the form and the scanned PDF version after signature are submitted at the same time.

(2) After this solicitation, those interested in patent open licensing can submit their applications at any time.

4. Support policies

The Provincial Intellectual Property Office confirms the patents declared open for licensing, announces them to the public through the provincial patent open licensing release platform and various patent open licensing sub-platforms, organizes publicity and promotion, and promotes patent licensing and transformation implementation. Patent licensing units that sign open licensing contracts and achieve good economic and social benefits after patent implementation will be given corresponding incentives and support.
