OPPO fights back against patent trolls in Germany, invalidating VoiceAge EVS patent

Before this, VoiceAge EVS actually had a good chance of winning, because the German Federal Patent Court's preliminary opinion was to maintain the validity of its patent. Now the case has been reversed.
It is reported that the patent EP3132443 that was invalidated this time involves "methods, encoders and decoders for linear prediction encoding and decoding of sound signals", and OPPO's invalidation requests were all supported. This time OPPO successfully invalidated the VoiceAge EVS patent is undoubtedly of great significance. For OPPO, there is no need to worry about the ban risk brought by the EP3132443 patent.
Just a few weeks ago, Xiaomi signed a patent licensing agreement with VoiceAge EVS under pressure from the German ban. The patent litigation case ended with VoiceAge EVS withdrawing the lawsuit.
Public information shows that VoiceAge EVS was established on November 27, 2018. It is a subsidiary of Fortress Investment Group acquired by SoftBank. After its establishment, VoiceAge, one of the major contributors to EVS codec technology, announced a strategic transaction with Fortress Investment Group and transferred the EVS patent portfolio to VoiceAge EVS. EVS is supported by most major operators and device manufacturers around the world due to its ability to provide a wider frequency range, higher compression rates and other features than other codecs. EVS patents have also become a "powerful weapon" for VoiceAge EVS to frequently file patent infringement lawsuits against smartphone manufacturers such as OPPO, TCL, Xiaomi, and HMD. Countries such as Germany and the United States have also become the company's main battlefields.
Analyzing the litigation cases of HD encoding and decoding technology companies, it can be found that VoiceAge EVS's EVS patent complies with the standards and is highly stable, making it difficult to be invalidated. Before the invalidation decision of the German Federal Patent Court, VoiceAge EVS had almost never failed in Germany. In August 2021, the Munich District Court ruled that HMD infringed the EP2707687 patent held by VoiceAge EVS and issued a sales ban. The Mannheim District Court also made the same judgment before this, and TCL, Lenovo, Apple, Manufacturers such as Xiaomi chose to reach a settlement with the company.
It is understood that other cases involving VoiceAge EVS v. OPPO are still ongoing.
