What are the patent transfer procedures and how long does it take?

The patent transfer procedure is to sign the transfer contract first, and then to the patent administration department of the intellectual Property Office for record registration and announcement. There is no clear regulation of the time required for the transfer of a patent. The transfer of a patent right shall take effect from the date of registration by the patent administration department under The State Council.
Q: What are the patent transfer procedures?
A: The patent transfer procedure is:
(1) Chinese patent inventors need to obtain the approval of the national patent administration before they can transfer the patent right or patent application right to other countries;
2. Both parties to the transfer of patent rights must sign a written transfer contract in accordance with relevant laws and regulations;
3. The transfer of patent rights must be registered with the patent administration department of China;
4. Submit the signed invention patent transfer contract and the declaration of the change of the description project to the patent administration department of our country and pay the patent transfer fee. After approval and announcement, the patent transfer procedure is completed and the contract officially takes effect.
Q: How long does it take to transfer a patent?
A: There is no clear rule on how long it takes for a patent to be transferred.
Where the right to apply for a patent or the patent right is assigned, the parties shall conclude a written contract and register it with the patent administration department under The State Council, which shall publish it.
