Recently, the National Development and Reform Commission, the Ministry of Science and Technology, the Ministry of Public Security, and the State Intellectual Property Office jointly issued the "Notice on Deeply Promoting the Reform of the Intellectual Property Protection System and Mechanism in the Comprehensive Innovation Reform Pilot Area" (hereinafter referred to as the "Notice").

The "Notice" requires that a number of reform measures be deployed in eight comprehensive innovation reform pilot areas including Beijing, Tianjin and Hebei, striving to achieve substantial breakthroughs in intellectual property protection and create a good atmosphere that encourages innovation. The "Notice" focuses on replicating and promoting the results of intellectual property protection reform, actively exploring the reform of comprehensive intellectual property management, actively exploring new mechanisms for intellectual property protection, actively exploring the establishment of new mechanisms for the connection between intellectual property administrative law enforcement and criminal justice, and continuing to implement the State Council's authorization first. Guiding opinions were put forward in seven aspects, including pilot intellectual property protection reform measures, new reform measures to be included in key tasks of comprehensive innovation reform trials, and research and formulation of detailed implementation work plans.

The "Notice" points out that all reform pilot areas must conscientiously implement the requirements of the "Notice of the General Office of the State Council on Promoting Reform Measures to Support Innovation" and effectively replicate and promote the reform measures of "patent rapid review, confirmation of rights, and one-stop service for rights protection" work, shorten the patent review cycle, improve the efficiency of intellectual property rights protection, reduce the cost of corporate rights protection, and stimulate the motivation and vitality of corporate innovation. Each reform pilot area should combine the actual conditions of the region to promote the formation of a comprehensive intellectual property management system with clear boundaries of authority, reasonable division of labor, consistent responsibilities and powers, and efficient operation, open up the entire chain of intellectual property creation, use, protection, management, and services, and achieve various goals. comprehensive benefits of similar intellectual property rights. We will solidly promote the construction of a strong province and city with intellectual property rights, build a number of intellectual property protection centers in advantageous industry clusters, and strive to create intellectual property protection demonstration areas.

The "Notice" proposes to actively explore new mechanisms for intellectual property protection. Each reform pilot area must refine the administrative discretionary standards for intellectual property rights, optimize the administrative law enforcement investigation and evidence collection system and law enforcement procedures, and severely crack down on serious illegal infringements, repeated infringements and other vicious illegal activities through means such as confiscating, sealing, detaining, and destroying infringing products in accordance with the law. In conjunction with the pilot program approved by the State Council, we must promptly promote the pilot implementation of reform measures related to intellectual property protection and accelerate the formation of reform results that can be replicated and promoted. Three reform measures, including promoting the comprehensive management reform of intellectual property rights, exploring new mechanisms for intellectual property protection, and establishing a new mechanism for linking intellectual property administrative law enforcement and criminal justice, shall be regarded as key reform tasks in the comprehensive innovation reform experiment in 2018, and strive to form a number of promising solutions.
