A: The patent open license system also includes invention patent, utility model and design three types of patent. After obtaining the patent right, the right holder may voluntarily submit an open license statement to the national patent administration department to specify the license fee, which will be announced by the national patent administration department. Any person may implement the patented technological achievement in accordance with the conditions of the patent open license. Where a declaration of open license is made for a patent for utility model or design, a patent right evaluation report shall be provided.
