In order to thoroughly implement the Party Central Committee’s decision-making and deployment on comprehensively strengthening the protection of intellectual property rights, in accordance with the relevant work requirements of the “14th Five-Year Plan for National Intellectual Property Protection and Utilization Plan” and in accordance with the “Measures for the Construction and Management of National Geographical Indication Product Protection Demonstration Zones (Trial) )" (State Intellectual Property Office Fa Bao Zi [2021] No. 4, hereinafter referred to as the "Measures"), carry out the application and recommendation work for the construction of national geographical indication product protection demonstration zones in 2022. The relevant matters are hereby notified as follows:

1. Scope of application

(1) The application unit for demonstration zone construction is the people's government at or above the county level, and the recommending unit is the provincial (autonomous region, municipality) intellectual property office. In accordance with the relevant work requirements for supervision and incentives of the State Council, combined with the need to implement the China-EU Geographical Indication Agreement and the quantity and work basis of relevant local geographical indication products, each reporting unit is limited to reporting one demonstration area, and the number of recommended units shall not exceed the number of places allocated (Annex 1 ).

(2) The construction of the demonstration zone is mainly to protect local advantages and characteristics and geographical indications with high added value after deep processing. The geographical indication product protection has been announced or the geographical indication has been registered as a collective trademark or certification trademark for more than 3 years.

(3) It has a large industrial scale, high annual sales or exports, the number of users of the special signs of geographical indications reaches more than 60% of the total number of producers in the region, and the output value of enterprises using special signs of geographical indications reaches the output value of relevant industries in the region. More than 60%.

(4) Priority shall be given to geographical indications that assist rural revitalization, inherit historical and cultural skills, and are expected to achieve greater economic, social and ecological benefits.

(5) Provide key support to geographical indications included in the Agreement on the Protection and Cooperation of Geographical Indications between the People’s Republic of China and the European Union.

2. Construction tasks

Focus on strict protection of geographical indications and deepen the reform of geographical indication management. According to the "Guiding Opinions of the State Intellectual Property Office and the State Administration for Market Regulation on Further Strengthening the Protection of Geographical Indications" and the "14th Five-Year Plan for the Protection and Utilization of Geographical Indications of the State Intellectual Property Office" And each locality actually determines specific work tasks, learns from the experience of the established national geographical indication product protection demonstration zone, and focuses on promoting the implementation of consolidating the protection system, improving the work system, increasing protection efforts, strengthening protection publicity, and strengthening win-win cooperation.

(1) Consolidate the protection system and lead coordinated advancement. Establish and improve the geographical indication protection system with social co-governance, strengthen regional resource integration and institutional connection, formulate long-term development plans, highlight new development concepts, introduce coordinated and supporting protection and management policies, formulate specific work plans and safeguard measures, and unify and standardize management Geographical indications.

(2) Improve the work system and lead the characteristic quality. Establish and improve the geographical indication protection standard system, inspection and testing system and quality management system, formulate a series of standards, improve testing capabilities, strengthen the construction of testing institutions, strengthen the quality control of origin, and ensure that the quality and characteristics of geographical indication products are outstanding. Strengthen the supervision of the use of special signs for geographical indications, and promote the full coverage of the use of special signs for geographical indications by market entities that meet the requirements in the place of origin.

(3) Increase protection efforts and lead the improvement of the level. Carry out special actions for the protection of geographical indications, strengthen administrative protection, cross-departmental collaborative protection, and cross-regional joint protection in the field of geographical indications, disclose typical cases with social influence, strictly investigate and deal with illegal acts of geographical indication infringement, and comprehensively use law, administration, economics, and technology , social governance and other means to improve the level of geographical indication protection and create a good business environment.

(4) Strengthen protection publicity and lead awareness raising. Strengthen the publicity and implementation of geographical indication protection policies and the guidance of public opinion, and carry out activities such as introducing geographical indication protection into enterprises, markets, communities, schools, and the Internet. Strengthen the construction of professional talent teams for geographical indication protection and continuously promote the improvement of the protection awareness of producers, operators and consumers.

(5) Strengthen win-win cooperation and lead market development. Improve the protection mechanism of foreign-related geographical indications, actively participate in international cooperation on mutual recognition and mutual protection of geographical indications, expand overseas markets in an organized manner through various international exchange and cooperation platforms, and promote the "going out" of Chinese geographical indication products.

3. Application procedure requirements

(1) The intellectual property offices of all provinces (autonomous regions and municipalities directly under the Central Government) organize relevant units to apply voluntarily, fill in the "Declaration Form for the Construction of National Geographical Indication Product Protection Demonstration Zone" (Annex 2), and provide opinions on the application for the construction of the demonstration zone in accordance with the requirements of the "Measures".

(2) If the intellectual property offices of each province (autonomous region, municipality) decide to recommend submission, fill in the "Recommended Information Summary Form for Application for the Construction of National Geographical Indication Product Protection Demonstration Zone" (Annex 3), submit the application materials (stamped with the official seal of the unit) and their The electronic version must be submitted to the Intellectual Property Protection Department of the State Intellectual Property Office before June 20, 2022.

(3) The State Intellectual Property Office shall organize a comprehensive review of the application for the construction of demonstration zones and publicize the list of preparations for the construction of demonstration zones.
