Does registering a company's name give it trademark protection for the same name as the company? If I want to apply for a trademark in my company's name, what should I do if other companies are also in the process of applying for it?
Answer:
Trademarks and enterprise names belong to different legal adjustments respectively. Trademark registration is adjusted by the Trademark Law and the Regulations for the Implementation of the Trademark Law, while enterprise name registration is adjusted by the Provisions on the Administration of Enterprise Name Registration. Moreover, trademark registration is unified, i.e. the Trademark Office of the State Administration for Industry and Commerce (SAIC) is responsible for trademark registration throughout the country; enterprise name registration is hierarchical, i.e. administrations for industry and commerce at all levels are responsible for the registration of enterprise names of different natures.
