China's trademark law stipulates that if a registered trademark becomes the generic name of the goods approved for use or is not used for three consecutive years without good reason, any unit or individual may apply to the Trademark Office to revoke the registered trademark.
Changing the registered trademark and its registration information on its own. After the registration of a trademark, the trademark registrant cannot change the registered trademark by himself. For example, the words, graphics, colors, etc. of the registered trademark are changed, and then the logo of the registered trademark is added. If it is necessary to change, you should apply for a new trademark again. The trademark registrant may not change the name, address or other registration matters on its own. If it is necessary to change, it should apply to the Trademark Office according to the requirements of the Trademark Office, pay the fee, and make the change.
China's Trademark Law provides that: in the course of using a registered trademark, a trademark registrant changes the registered trademark, the name, address of the registrant or other registered matters, the local administrative department for industry and commerce shall order rectification within a time limit; If it fails to make corrections within the time limit, the Trademark Office shall cancel its registered trademark.
In accordance with the law, any party dissatisfied with the decision of the Trademark Office to revoke or not revoke a registered trademark may, within 15 days from receipt of the notification, apply to the Trademark Review and Adjudication Board for a review. If the party concerned is not satisfied with the decision of the Trademark Review and Adjudication Board, it may bring a suit in a people's court within 30 days from the date of receipt of the notification.
