What is the expedited preexamination of patent applications?
The pre-examination service of patent application is the pre-examination of the application documents by the Protection Center before the patent application is formally submitted to the State Intellectual Property Office, so that qualified patent applications enter the rapid examination channel.
What is the pre-trial process?
1) The applicant that has completed and passed the filing in the Protection Center shall submit the patent application materials for rapid pretrial application to the Protection Center through the pretrial case submission system of the pretrial management platform;
2) The Protection Center shall conduct a pre-examination examination of the pre-examination application materials and form a pre-examination conclusion;
3) If the patent application is not approved by the pre-examination examination of the Protection Center, the applicant may submit the patent application to the State Intellectual Property Office in accordance with the ordinary procedures;
4) The patent application that has passed the pre-examination examination by the Protection Center will be allowed to enter the fast examination channel, and the applicant shall submit the patent application in XML format to the State Intellectual Property Office through the patent Electronic Application System CPC client of the China Patent Electronic Application Network in time. After the patent application number is obtained, the online payment shall be completed immediately, and the patent application number and payment voucher shall be submitted to the Protection Center by logging in to the pre-trial case submission system within the same day;
5) The Protection Center will review the officially submitted patent application, and after passing the examination, mark the patent application number and submit it to the State Intellectual Property Office.
