A: According to Article 13 of the Trademark Law , "Where a trademark applied for registration in respect of identical or similar goods is a copy, imitation or translation of another person's well-known trademark that has not been registered in China and is likely to cause confusion, it shall not be registered and shall be prohibited from use." Where a trademark applied for registration in respect of a different or dissimilar commodity is a reproduction, imitation or translation of another person's well-known trademark already registered in China, which misleads the public and may cause damage to the interests of the registrant of the well-known trademark, it shall not be registered and shall be prohibited from use."
Therefore, it is recommended not to use the trademark without the authorization of the well-known trademark owner and the trademark Office of the State Administration for Market Regulation before the registration of the trademark license.
