Paragraph 4 of Article 13 of the Regulations of the People's Republic of China on the Implementation of the Trademark Law stipulates that where an application for trademark registration is made in respect of a combination of colors, a declaration shall be made in the application, stating the manner in which the trademark is to be used. The use of color combination of trademarks in a variety of ways, the applicant for trademark registration shall be based on the specific use of color combination of trademarks to explain. Trademark registration applicant should be in the "trademark registration application" "trademark description" column, explain how the color combination of trademarks in the declaration of goods or services used. For example, explain the color combination trademark is used in the declaration of all the appearance of the goods or used in a particular part of the goods; and, for example, explain how the color combination trademark is used in the declaration of services to distinguish the source of services.
Simply put, the manner of use of a trademark is the manner in which the applicant uses the trademark, such as in what manner or under what circumstances the applicant uses the trademark in relation to the goods or services for which the application is filed. For example, the shape of the candy produced by the applicant is a special three-dimensional logo shape, so when the applicant applies for trademark registration of the three-dimensional logo on the 30th class of goods "candy", the way of use of the trademark can be filled in as "the three-dimensional logo is used on the shape of the candy. ".
When applying for trademark registration with three-dimensional signs, color combinations or sound signs, the way of using the trademark should be stated in the column of "Trademark Description".
