Q: How to register the pledge of patent right?
A:
Patent pledge refers to the debtor or a third party will have the patent rights to guarantee the performance of its debt, when the debtor does not perform the debt, the creditor has the right to discount, auction or sale of the patent rights of the proceeds of the priority to be paid.
To apply for registration of pledge of patent right, the parties shall submit the following documents to the State Intellectual Property Office:
(1) Application form for registration of pledge of patent right jointly signed or sealed by the pledgor and the pledgee;
(2) Patent right pledge contract;
(3) Identity certificates of both parties;
(4) A power of attorney indicating the power of entrustment in case of entrustment;
(5) Other materials to be provided.
Where the patent right has undergone asset evaluation, the parties shall also submit an asset evaluation report.
In addition to the identity certificate, other documents submitted by the parties shall be in Chinese. If the identity certificate is in a foreign language, the party concerned shall attach a Chinese translation; If not attached, it shall be deemed not submitted.
